ITEM #3 Proclamation to Honor Edward Deeb, Ellis Island Medal of Honor Recipient

MOTION by Jamian and SUPPORT by Buckley to ADOPT the Proclamation Honoring Edward Deeb, Ellis Island Medal of Honor Recipient.

RESOLUTION IN HONOR OF EDWARD DEEB

WHEREAS, Edward Deeb, a Township resident, received the Ellis Island Medal of Honor on May 10, 2008; and

WHEREAS, this tribute ranks among our nation’s most prestigious awards and is only given to a select group of Americans who have distinguished themselves unselfishly in all areas of community service; and

WHEREAS, the Ellis Island Medal of Honor is awarded annually to illustrious Americans who exemplify a life dedicated to community service; and

WHEREAS, the honorees must devote themselves to supporting and defending the values of American life, and build bridges between ethnic, racial, and religious groups in the United States and/or abroad; and

WHEREAS, the recipients are cited for sharing their personal and professional gifts for the benefit of humanity, and preserve and celebrate the history, traditions and values of their ancestry groups; and

WHEREAS, Ed has been a community leader and activist, as well as peacemaker, working diligently as a liaison between businesses and the community; and

WHEREAS, Ed currently serves as president and CEO of the Michigan Food and Beverage Association as well as the Michigan Business and Professional Association, whose combined membership equals 20,000 businesses and employs over 160,000 people; and

WHEREAS, Ed has contributed his time to numerous community organizations such as Chairman of the Salvation Army, Board of Directors for the Boys and Girls Clubs of SE Michigan, Board of Directors for the United Way of SE Michigan, Board of Directors for the American Red Cross and Governance Board of Goodwill Industries; and

WHEREAS, Ed has received numerous awards and honors such as the Point of Light Award, Distinguished Alumni Award from Michigan State University, Induction into the International Heritage Hall of Fame, 2002 Michiganian of the Year by The Detroit News, Distinguished Warriors Award from the Detroit Urban League, 2007 Peacemaker of the Year Award from Wayne State University, and Honorary Member of the Marine Corps among many, many others.

NOW, THEREFORE BE IT RESOLVED, that the past and present members of the Board of Trustees and the residents of Bloomfield Township HONOR EDWARD DEEB for his many years of dedicated community service.

ITEM #4 Proclamation to Honor Gayle Murphy, Oakland County Drain Commission/Lake Board Member

MOTION by Barnett and SUPPORT by Jamian to ADOPT the Proclamation Honoring Gayle Murphy, Oakland County Drain Commission/Lake Board Member.

RESOLUTION IN HONOR OF GAYLE MURPHY

WHEREAS, Gayle Murphy, an Oakland County resident, has served as the Community Liaison for the Oakland County Drain Commissioner on seven Bloomfield Township lake boards for over seven years; and

WHEREAS, the Township appreciates the strong working relationship with the Oakland County Drain Commission sustained by Gayle and her expertise on managing lake boards; and

WHEREAS, we appreciate Gayle’s two editions of lake board polices and procedures distributed in written and electronic form to all communities; and

WHEREAS, we are grateful for her strong commitment to the lake boards in Bloomfield Township, and especially her mentoring of the Bloomfield Township Clerk as the lake board secretary; and

WHEREAS, Gayle has contributed to the well-being of Oakland County and the State of Michigan for over 20 years in previous positions which include District Representative to former Senator Bouchard, District Representative and Administrative Assistant to former Senator Fessler, Executive Vice President of the Detroit Board of Realtors, and Deputy Director of the Republican Committee of Oakland County; and

WHEREAS, we truly regret her retirement from the position of Community Liaison to the Oakland County Drain Commission, but wish her well in her entrepreneurial venture within her 1822 farmhouse.

NOW, THEREFORE BE IT RESOLVED, that the past and present members of the Board of Trustees and the residents of Bloomfield Township HONOR GAYLE MURPHY for her years of service and many contributions to enhancing the lake boards in Bloomfield Township.

Supervisor Payne stated that this is a worthwhile organization that does great work.

ITEM #6 Consider Adoption of Ordinance 599, Establishing a Water Debt Charge

This ordinance would create an $8.00 water service charge (primary meters) that would be billed on a quarterly basis. It was introduced to the Board at their last meeting on June 9, 2008.

ORDINANCE NO. 599

An Ordinance to amend Chapter 38 of the Charter Township of Bloomfield Code of Ordinances, Utilities, to amend Article VI, Rates and Charges, Division 2, Water, for the purpose of establishing a water debt service charge.

THE CHARTER TOWNSHIP OF BLOOMFIELD ORDAINS:

Section 1 of Ordinance

Chapter 38, Article VI, Division 2, Section 38-221 of the Bloomfield Township Code is hereby amended to insert a new Section 38-221, and re-number existing Sections from 38-221 to 38-227 accordingly:

Sec. 38-221. Water debt service charge.

In addition to the capital, direct connection, water consumption and meter charges provided hereinbefore, there shall be an annual debt service charge of $32.00 per residential equivalent unit for the first 15 residential equivalent units and $4.00 per residential equivalent unit for additional units up to a maximum of 200 residential equivalent units for each premises connected to the water supply system, such charge to continue until any and all indebtedness for the water supply system is retired by the Township. The collection of the debt service charge shall be included on all water billings, with the exception of secondary meters, which will be billed quarterly at $8.00 per residential equivalent unit or monthly at $2.67 residential equivalent unit. Once a premises has been connected to the water supply system, subsequent changes in the character of the use of said premises, including partial or total destruction, removal or abandonment of any or all improvements thereon, shall not abate the obligation to continue the payments of the debt service charge assigned at the time of connection, and if subsequent changes in the use of the premises increase the residential equivalent unit, the township may increase the residential equivalent unit assigned to the premises for payment of the debt service charge for the remainder of the debt period. The debt service charges shall apply to all water bills effective July 1, 2008.

Section 2 of Ordinance

Repealer

All ordinances or parts of ordinances in conflict with this ordinance are repealed only to the extent necessary to give this ordinance full force and effect.

Section 3 of Ordinance

Severability.

Should any section, subdivision, clause, or phrase of this ordinance be declared by the courts to be invalid, the validity of the ordinance as a whole, or in part, shall not be affected other than the part invalidated.

Section 4 of Ordinance

Savings.

All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this ordinance takes effect are saved and may be consummated according to the law in force when they were commenced.

Section 5 of Ordinance

Effective Date.

The provisions of this Ordinance are ordered to take effect following publication in the manner prescribed by statute.

Section 6 of Ordinance

Adoption.

ITEM #7 Introduction of Ordinance 601, Amendment for Parking Requirements

The Township’s parking requirements were originally adopted in 1974 and have had only one amendment, which was in 1981. Surrounding community standards were reviewed for their method of calculating parking requirements and it was determined that changes to the Township’s current parking provisions were needed.

AN ORDINANCE TO AMEND THE CODE OF ORDINANCES OF BLOOMFIELD TOWNSHIP, CHAPTER 42, ZONING TO AMEND THE PARKING REQUIREMENTS AND PARKING SPACE LAYOUT REQUIREMENTS

THE TOWNSHIP OF BLOOMFIELD ORDAINS:

Article 1, Section 42-3 Definitions of the Bloomfield Charter Township Code, is hereby amended to read as follows:

Section 1.

Section 42-3. Definitions

Floor Area, Gross (For the purpose of computing parking): Is the sum in square feet of the area of each floor level in a building as measured from exterior walls. Cellars, basements, mezzanines, penthouses, corridors and lobbies that are within the principle outside faces of exterior walls are included, except architectural setbacks or projections. Included are all areas that have floor surfaces with clear standing head room (six ft. six in. (6 ft. 6 in.) minimum) regardless of their use, excluding unroofed areas, and unenclosed roofed over spaces, except those contained within the principal outside faces of the exterior walls. For purposes of computing parking, the predominant use will prevail in determining the total number of parking spaces required per building.

Landbanking: Is the method of designating landscape area for future additional parking to allow for flexibility in meeting changing parking needs.

Section 2.

Section 42-560. Parking requirements

1) The minimum number of off-street parking spaces by type of use shall be determined in accordance with the following schedule:

(1) Residential, one-family, two family Two (2) for each dwelling unit.
(2) Residential, multiple-family Two (2) for each dwelling unit.
(3) Housing for the elderly One (1) for each two (2) units, and one (1) for each employee. Should units revert to general occupancy, then two (2) spaces per unit shall be provided.
(4) Trailer court (mobile home park) One (1) for each trailer site and one (1) for each employee of the trailer court.
b. Institutional  
(1) Places of worship One (1) for each three (3) people permitted by the Adopted Fire Code.
(2) Hospitals Two and one-half (2.5) for each bed plus parking for related uses.
(3) Homes for the aged and convalescent homes One (1) for each six (6) beds, one (1) for each two (2) employees and/or members of the staff.
(4) Elementary and middle schools One (1) for each one (1) teacher, employee or administrator in addition to the requirements of the auditorium.
(5) Senior high schools One (1) for each one (1) teacher, employee or administrator and one (1) for each (10) ten students, in addition to the requirements of the auditorium.
(6) Private clubs or lodge halls One (1) for each three (3) persons allowed within the maximum occupancy load as established by local, county, or state fire, building or health codes.
(7) Private golf clubs, swimming clubs, tennis clubs, or similar uses One (1) for each two (2) member families or other individual members.

(8) Golf courses open to the general public, except miniature or "par-3" courses

Six (6) for each one (1) golf hole and one (1) for each employee.

(9) Fraternity or sorority

One (1) for each five (5) persons allowed within the maximum occupancy load.

(10) Stadium, sports area, similar place of outdoor assembly

One (1) for each three (3) seats or six (6) feet of benches.

(11) Theaters and auditoriums

One (1) for each three (3) seats.

c. Business and commercial

 

(1) Retail Center

a. less than 50,000 gross square foot

b. 50,000 - 200,000 gross square foot

c. Over 200,000 gross square foot

a. One (1) space for each two hundred (200) square feet of gross square footage.

b. One (1) space for each two hundred twenty-five (225) square feet of gross square footage.

c. One (1) space for each two hundred fifty (250) square feet of gross square foot.

For any retail center including uses such as restaurants, cinemas, entertainment, or recreation uses with a combined gross square footage exceeding twenty percent (20%) of the total gross square foot of the retail center, a shared parking study shall be submitted to determine the appropriate parking ratio by the Township.

(2) Auto wash

One (1) for each employee. Stacking spaces must be equal to five (5) times the maximum capacity of the auto wash.

(3) Beauty parlor, nail salon, tanning salon or barber shop

Three (3) for each of the first two (2) chairs and one and one half (1.5) spaces for each additional chair. The first such use in a retail center shall be calculated at one (1) for each two hundred (200) square feet of gross floor area.

(4) Bowling alleys

Five (5) for each bowling lane.

(5) Dance halls, pool or billiard parlors, roller or ice-skating rinks, exhibition halls, and assembly halls without fixed seats

One (1) for each three (3) people allowed within the maximum occupancy load OR one (1) for each one hundred twenty five (125) square feet of gross floor area.

(6) Restaurants

a. with drive-up service

b. for specialty beverage, food or refreshments, such as coffee shops, bakeries, ice cream parlors, and other similar uses

One (1) space for each seventy-five (75) square feet of gross square footage.

a. One (1) space for each seventy (70) square feet of gross square footage to include three (3) stacking spaces provided for each drive-up lane in total parking provided.

b. One (1) space for each two hundred (200) square feet of gross square footage.

(7) Furniture store or showroom

One (1) for each one thousand (1000) square feet of gross floor area.

(8) Fuel stations that may include service bays and retail areas

One (1) for each three hundred (300) square feet of gross floor area.

(9) Laundromats and coin operated dry cleaners

One (1) for each two (2) machines.

(10) Miniature or ''Par-3'' golf courses

Three (3) for each one (1) hole.

(11) Funeral homes

One (1) for each sixty (60) square feet of gross floor area.

(12) Motel, hotel, or other commercial lodging establishments

One (1) for each rental unit plus one (1) space for each twenty-five (25) units plus parking for accessory uses.

(13) Motor vehicle sales and service establishments

One (1) for each three hundred (300) square feet of gross floor area of sales room plus one (1) space for each auto service stall.

(14) Retail stores except as and otherwise specified herein

One (1) for each two hundred (200) square feet of gross floor area.

(15) Wholesale Retail stores

One (1) for each three hundred (300) square feet of gross floor area.

(16) Health clubs

One (1) for each one hundred seventy-five (175) square feet of gross floor area plus spaces for food or beverage service.

(17) Self-storage facility

Five (5) spaces for the office. Access to individual storage units shall provide for loading and unloading of vehicles adjacent to units without impeding traffic flow.

(18) Commercial day care centers

One (1) for each three hundred (300) square feet of gross floor area.

d. Offices

 

(1) Banks

One (1) for each two hundred and twenty five (225) square feet of gross floor area. In addition, three (3) stacking spaces shall be provided for each drive-up lane.

(2) Business offices or professional offices except as indicated in the following item.

One (1) for each two hundred and seventy five (275) square feet of gross floor area.

(3) Professional offices of doctors, dentists, veterinary, or similar professions.

One (1) for each one hundred and seventy five (175) square feet of gross floor area.

e. Industrial

 

(1) Industrial or research

One (1) for each seven hundred (700) square feet of gross floor area.

(2) Wholesale establishments, distribution and warehouse

One (1) for each two thousand (2000) square feet of gross floor area.

2) Upon submission of a parking study, approved by the Township traffic engineer, the total number of required parking spaces may be reduced by the Planning Commission in the site plan review process.

Section 3.

Section 42-561. Off-Street Parking Space Layout, Standards, Construction and Maintenance.

The parking area shall be so designed to include landscape and provide a tree plantings as required below. A plan for the proposed landscape and tree planting shall include native plantings and be submitted to the Planning Commission showing the following intended layout (Illus.):

a. A landscape and tree planting plan showing an even distribution of trees throughout the parking areaplan. Trees of three (3) inch caliper or greater as suggested in Section 42-565 (2)e, shall be planted at the rate of one (1) tree for each six (6) vehicles to be provided for. These trees shall be maintained in a healthy growing condition.

b. A tree planting plan showing a pattern of trees throughout the parking area. Trees of three (3) inch caliper or greater of the variety suggested in Section 42-565 (2) e, shall be planted at the rate of one (1) tree for each six (6) vehicles to be provided for. These trees shall be maintained in a healthy growing condition. Under this arrangement the trees shall not be considered a part of any required greenbelt, it being the intent of this Section to provide a canopy throughout the parking area.

c. Each planting bed shall be a continuous earth planting bed at least eight (8) feet wide and a minimum of three hundred (300) sq. ft. in area. Landscape materials shall be planted no closer than four (4) ft. to the property line.

The land designated for landbanking for additional parking shall be clearly identified on the approved site plan.

d. Trees planted within land designated as landbanked parking spaces shall not count toward the total number of trees required per parking spaces as specified in this Section.

Section 4. Repealer.

All Ordinances or parts of Ordinances in conflict herewith are hereby repealed only to the extent necessary to give this Ordinance full force and effect.

Section 5. Savings.

All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this Ordinance takes effect, are saved and may be consummated according to the law when they were commenced.

Section 6. Severability.

If any section, clause or provision of this Ordinance shall be declared to be unconstitutional, void, illegal or ineffective by any Court of competent jurisdiction, such section, clause or provision declared to be unconstitutional, void or illegal shall thereby cease to be a part of this Ordinance, but the remainder of this Ordinance shall stand and be in full force and effect.

Section 7. Effective Date.

The provisions of this Ordinance are hereby ordered to take effect immediately upon publication in the manner prescribed by law.

Section 8 Adoption.

This Ordinance is hereby declared to have been adopted by the Township Board of the Charter Township of Bloomfield at a meeting thereof duly called and held on the ____ day of __________, 2008, and ordered to be given publication in the manner prescribed by law.

ITEM #8 Amendment to Agreement for Cable Access Management Between The Birmingham Area Cable Board and Bloomfield Community Television

The amendment is for the renewal of an existing agreement between the Township and the Birmingham Area Cable Board. The agreement contains a slight increase above the previous annual amount and would be for two years instead of one. Supervisor Payne stated that it was a good example of cooperation and consolidation of services between communities.

MOTION by Jamian and SUPPORT by Buckley to APPROVE the Amendment to the Agreement for Cable Access Management Between The Birmingham Area Cable Board and Bloomfield Community Television.

ITEM #9 Consideration of Participation in Oakland County’s Community Development Block Grant (CDBG) Program

MOTION by Devine and SUPPORT by Barnett to ADOPT the Participation in the Community Development Block Grant (CDBG) Program Resolution.

Community Development Block Grant (CDBG) Program

Oakland County, Michigan Urban County Qualification

2009-2011 Resolution

WHEREAS, Bloomfield Township is eligible for participation in the Oakland County Urban County Program; and

WHEREAS, Membership in the program will allow Bloomfield Township the option of applying for Community Development Block Grant funding; and

WHEREAS, The proposed use of this fund will be to assist low and moderate income Bloomfield Township seniors aged 62 and over with Minor Home Repair (MHR).

NOW THEREFORE BE IT RESOLVED that the Bloomfield Township Board of Trustees approves participation in Oakland County’s Urban County Community Development Block Grant (CDBG) programs for the years 2009, 2010 and 2011.

BE IT FURTHER RESOLVED that Bloomfield Township will remain in Oakland County’s Urban County Community Development programs, which shall be automatically renewed in successive three-year qualification periods of time, or until such time that it is in the best interest of the local Community to terminate the Cooperative Agreement.

ITEM #10 Hardship Exemption Guidelines Revisions

The Township does not receive very many hardship applications, but due to the affluent nature of the community and tough economic times, the following changes are proposed by Bill Griffin, Assessor, to the Hardship Exemption Guidelines prior to the 2008 July Board of Review:

1) Increase the true cash value from less than $200,000.00 to less than $350,000.00.

2) Increase the maximum amount in savings/checking from $10,000.00 to $20,000.00.

The Trustees agreed that these revisions were a way to assist individuals in the community.

MOTION by Savoie and SUPPORT by Buckley to APPROVE the Hardship Exemption Guidelines Revisions.

AYES: Barnett, Buckley, Devine, Jamian, Payne, Roncelli, Savoie

ITEM #11 Consider Approval of Fireworks Application for Hammond Lake Civic Association

The display is scheduled for July 12, 2008, at dusk and all Township requirements were met.

MOTION by Buckley and SUPPORT by Barnett to APPROVE the Fireworks Permit for Hammond Lake Civic Association.

AYES: Barnett, Buckley, Devine, Jamian, Payne, Roncelli, Savoie

ITEM #12 Reconsider Wing Lake Road Safety Path Construction

Part of the 2004 Master Plan for Safety Paths included a safety path on Wing Lake Road from 14 Mile Road to Maple Road. Last week Supervisor Payne, Clerk Roncelli and Treasurer Devine met with homeowners on Wing Lake Rd. who voiced their objection to the installation of this path. Supervisor Payne advised the Board that due to opposition regarding this project, the installation should be postponed and reconsidered at a future date, as there are many other safety paths that can be completed at this time.

MOTION by Barnett and SUPPORT by Jamian to POSTPONE the Wing Lake Road Safety Path Construction, but Not Delete it from The Safety Path Master Plan AND Reconsider it at a Future Date.

ITEM #13 Consider a Four Ten-Hour Day Work Week on a Trial Basis

In reaction to drastically rising fuel prices, Township administration has been studying the feasibility of enacting a ten-hour four-day workweek. Department Heads were asked to evaluate their departments to see if this schedule change would be practical. At the last Board meeting on June 9, 2008, Trustee Savoie had suggested a Monday through Thursday schedule. Some departments have very small staffs and to extend hours and be open five days may diminish customer service. Also, there is a possibility the Township will save money as well as the employee – lights are off, air conditioning/heat can be lowered, and the cleaning contract may be renegotiated/reduced by one day. Also, most of the Township’s information (forms and applications) is available on line.

Some Trustees felt that this was not a good time to change hours – that it would diminish service and that this initiative should be researched further. Others thought it was proactive and a good idea to attempt to lower utility costs. In addition, hours are being expanded, for residents, beyond traditional work hours (7:00 a.m. – 5:30 p.m.). Most of the Board did agree that there should be a trial period, which would need to be quantified to verify if the program works. A true measure of the success or failure of this venture will be the response of the residents.

MOTION by Savoie and SUPPORT by Buckley to APPROVE a Four-Day Workweek (Monday – Thursday) from 7:00 a.m. – 5:30 p.m. on a Trial Basis Through December 2008, Pending a Review at the Board of Trustees Meeting on September 22, 2008.
