ITEM #7 Board of Review Reappointments – Brian Kepes, Robert Taylor Jr. and John Swoboda (Renew until January 1, 2010)

Supervisor Payne advised the Board that, unfortunately, John Swoboda will not be able to retain membership on the Board of Review due to a new law which prohibits non-residents from sitting on a Board.

ITEM #8 Wetland Inventory Update/New Wetland Maps – Presented by Dr. Steven Niswander

In 2005, the Township applied for a grant to upgrade maps that were previously done in 1994. The new maps are required by the Township’s Wetland Ordinance and will be posted on the website by the New Year.

The data that was generated by this update will be integrated with CivicSight, the Township’s Geographic Information System (GIS). The staff will be able to use the wetland inventory on a regular basis, and it will help to enforce and update ordinances and preserve the wetlands. This new data can be easily updated because it is part of the GIS.

A notice was sent to Township residents advising of the update and only positive comments were received.

ITEM #9 Adult Day Service Update, First Year Chris Tvaroha, Director of Senior Services, made the presentation.

The Adult Day Service Program, which is part of the Senior Services Department, is celebrating its one-year anniversary. Currently, the program is at 26 percent capacity (14 active members).

Clerk Roncelli inquired why more money is being spent on staff than the program is receiving in revenue. Tvaroha explained that the program’s business plan accounts for this loss in revenue and projections forecast that in the fifth year the program will break even. Once the new Senior Services building is complete, projections may even drop to 3.5 years. Also, once the program reaches full capacity there may be consideration of extending hours to include weekends and evenings.

 

ITEM #10 Distribution of Absent Voter Ballot Application Forms

Based on new information received by the Township’s attorney, the absent voter ballot application forms, for the January 15th Presidential Primary, have been mailed, per past practice, to all residents on the permanent AV list and to those sixty years of age and older. The application allows the voter to mark whether they would like to remain on this list. It also requires the voter to choose a political party. If the voter does not mark a party designation, they must either come into the office to mark the form or it must be mailed back to the resident. An employee of the Township may NOT mark the application on behalf of the voter.

RESOLUTION REGARDING DISTRIBUTION OF ABSENT

VOTER BALLOT APPLICATIONS IN A MANNER CONSISTENT

WITH PRIOR PRACTICE

At a regular meeting of the Board of Trustees of the Charter Township of Bloomfield, County of Oakland, State of Michigan, held on December 10, 2007, the following Resolution was moved, supported and adopted.

R E C I T A T I O N S:

The Michigan Court of Appeals recently issued an opinion (October 25, 2007) in a case involving an injunction issued by the Wayne County Circuit Court stating that the then Detroit City Clerk, Jackie Currie—an elected official and a candidate for re-election—had improperly mass-mailed absentee voter ballot applications to voters on the so-called "permanent absentee ballot voter list," made up generally of voters 60 years and older; and

The Court of Appeals decision purports to state that municipal clerks are not authorized to mail "unsolicited" absentee voter ballot applications based upon the language of MCL 168.759(5), which states that "the clerk of the city, township, or village shall have absent voter ballot application forms available in the office of the clerk at all times and shall furnish an absent voter ballot application form to anyone upon verbal or written request"; and

The dissenting judge in the Currie case noted reasonably that the requirement that the clerk shall furnish forms upon verbal or written request was not the same thing as a prohibition on furnishing such applications without request; and

Under the same election law cited in the Court of Appeals’ opinion, any individual can send unsolicited absent voter ballot applications to voters within the Charter Township of Bloomfield; and

The Charter Township of Bloomfield Board of Trustees has wide-ranging authority under the Charter Township Act, MCL 42.1 et seq, that is to be liberally construed in its favor; and

The Bloomfield Township Board of Trustees recognizes that the Township Clerk’s office has maintained a permanent absentee voter list for many, many years and has—consistent with the idea of encouraging broad public participation in elections and enhanced voter access—sent absentee voter ballot application forms to individuals on that list as well as to others (e.g., those who had previously requested applications); and

Bloomfield Township voters have become accustomed to receiving ballot application forms from the Township Clerk’s office; and

The same concerns set forth in the Court of Appeals’ opinion regarding the Clerk’s office as an elected office is not present in this case; and

The inability of the Clerk to send absent voter applications to those voters who traditionally receive them may have an impact on the operation of the Township Clerk’s office with regard to increased staff time to address requests made during the work day and increased costs for individual mailings that were not contemplated within the Court of Appeals decision.

NOW, THEREFORE, BE IT RESOLVED THAT the Bloomfield Township Board of Trustees, pursuant to statutory authority, directs that absentee voter ballot applications be mailed on behalf of the Charter Township of Bloomfield for the election scheduled to occur on January 15, 2008 to voters on the Township’s permanent absentee voter list and to others whom the Township Clerk would have mailed such applications before the issuance of the above-referenced Court of Appeals’ opinion.

ITEM #11 Authorize Application State of Michigan for Annual Highway Work Permit – Presented by Tom Trice

This is a standard permit that is applied for each year. The permit is a requirement in order to perform work on Michigan Department of Transportation (MDOT) highways.

A complete copy of the State of Michigan Annual Highway Work Permit is available in the Clerk’s Office.

RESOLUTION FOR APPLICATION TO THE STATE OF MICHIGAN

FOR THE 2008 ANNUAL HIGHWAY WORK PERMIT

RESOLVES WHEREAS, the Charter Township of Bloomfield, Michigan hereinafter referred to as the "GOVERNMENTAL BODY, " periodically applies to the Michigan Department of Transportation, hereinafter referred to as the "DEPARTMENT," for permits, referred to as "PERMIT," to construct, operate, use and/or maintain utility or other facilities, or to conduct other activities, on, over, and under state trunkline right of way at various locations within and adjacent to its corporate limits;

NOW THEREFORE, in consideration of the DEPARTMENT granting such PERMIT, the GOVERNMENTAL BODY agrees that:

Each party to this Agreement shall remain responsible for any claims arising out of their own acts and/or omissions during the performance of this Agreement, as provided by law.

This Agreement is not intended to increase either party’s liability for, or immunity from, tort claims.

This Agreement is not intended nor shall it be interpreted, as giving either party hereto a right of indemnification, either by Agreement or at law, for claims arising out of the performance of this Agreement.

Any work performed for the GOVERNMENTAL BODY by a contractor or subcontractor will be solely as a contractor for the GOVERNMENTAL BODY and not as a contractor or agent of the DEPARTMENT. Any claims by any contractor or subcontractor will be the sole responsibility of the GOVERNMENTAL BODY. The DEPARTMENT shall not be subject to any obligations or liabilities by vendors and contractors of the GOVERNMENTAL BODY, or their subcontractors or any other person not a party to the PERMIT without its specific prior written consent and notwithstanding the issuance of the PERMIT.

The GOVERNMENTAL BODY shall take no unlawful action or conduct, which arises either directly or indirectly out of its obligations, responsibilities, and duties under the PERMIT which results in claims being asserted against or judgment being imposed against the State of Michigan, the Michigan Transportation Commission, the DEPARTMENT, and all officers, agents and employees thereof and those contracting governmental bodies performing permit activities for the DEPARTMENT and all officers, agents, and employees thereof, pursuant to a maintenance contract. In the event that the same occurs, for the purposes of the PERMIT, it will be considered as a breach of the PERMIT thereby giving the State of Michigan, the DEPARTMENT, and/or the Michigan Transportation Commission a right to seek and obtain any necessary relief or remedy, including, but not by way of limitation, a judgment for money damages.

It will, by its own volition and/or request by the DEPARTMENT, promptly restore and/or correct physical or operating damages to any State trunkline right of way resulting from the installation construction, operation and/or maintenance of the GOVERNMENTAL BODY’S facilities according to a PERMIT issued by the DEPARTMENT.

With respect to any activities authorized by PERMIT, when the GOVERNMENTAL BODY requires insurance on its own or its contractor’s behalf it shall also require that such policy include as names insured the State of Michigan, the Transportation Commission, the DEPARTMENT, and all officers, agents, and employees thereof and those governmental bodies performing permit activities for the DEPARTMENT and all officers, agents, and employees thereof, pursuant to a maintenance contract.

The incorporation by the DEPARTMENT of this resolution as part of a PERMIT does not prevent the DEPARTMENT from requiring additional performance security or insurance before issuance of a PERMIT.

This resolution shall continue in force from this date until cancelled by the GOVERNMENTAL BODY or the DEPARTMENT with no less than (30) days prior written notice to the other party. It will not be cancelled or otherwise terminated by the GOVERNMENTAL BODY with regard to any PERMIT which has already been issued or activity which has already been undertaken.

BE IT FURTHER RESOLVED, that the following position(s) are authorized to apply to the Michigan Department of Transportation for the necessary permit to work within state trunkline right of way on behalf of the GOVERNMENTAL BODY.

ITEM #12 Resolution to Amend Investment Policy and Proposed Amended Investment Policy

Every couple of years, this policy is reviewed to make sure it is up-to-date. Two small revisions are being made to the policy: the date will change from the year 2005 to 2007 and bank names will be updated due to mergers and acquisitions over the past two years.

A complete copy of the Investment Policy is available in the Clerk’s Office.

CHARTER TOWNSHIP OF BLOOMFIELD INVESTMENT AND

DEPOSITORY DESIGNATION POLICY AMENDMENT RESOLUTION

AS OF DECEMBER 10, 2007

WHEREAS, Michigan Compiled Laws Section 129.95 directs that a Township Board of Trustees, in consultation with the Township Treasurer, shall adopt an investment policy which shall require periodic review and appropriate amendments thereof, and

WHEREAS, the Bloomfield Township Board of Trustees adopted such a policy on September 14, 1998 and was last amended by the Board on February 28, 2005 pursuant to the recommendation of the Township Treasurer and Township Finance Director, and

WHEREAS, the existing policy has been reviewed again by the Township Treasurer and Township Finance Director and which requires appropriate amendment at this time to maximize potential investment gain for Bloomfield Township while adhering to the investment objectives and standards of prudence as previously adopted by the Board of Trustees, and

WHEREAS, Michigan Compiled Laws Section 41.77 directs the Township Treasurer to deposit money that comes into the Township into the financial institutions that the Township Board of Trustees approves, and

WHEREAS, several of the banking institutions previously approved by the Board have changed names due to mergers that have strengthened said institutions, and

WHEREAS, Fifth Third Bank has made a commitment to our municipality by opening two new branches in our community and Fifth Third Bank meets the criteria outlined in the investment policies previously approved by this Board as to institutional strength, and

WHEREAS, the attached amended document entitled "Bloomfield Township Investment and Depository Designation Policy as Amended as of December 10, 2007" is being recommended by the Township Treasurer and Township Finance Director for adoption by the Township Board of Trustees.

THEREFORE BE IT RESOLVED that the Board of Trustees for the Charter Township of Bloomfield authorizes adoption of the attached document to be entitled "Bloomfield Township Investment and Depository Designation Policy as amended as of December 10, 2007".

ITEM #13 Designate JPMorgan Chase Bank NA as the Depository for 2008 Tax Collection

MOTION by Buckley and SUPPORT by Stefanes to AUTHORIZE JPMorgan Chase Bank NA as the Depository for 2008 Tax Collections.

WHEREAS, the Bloomfield Township Board of Trustees must annually approve the banking institution that the Township shall utilize as its depository for tax collection deposits, and

WHEREAS, JPMorgan Chase Bank NA, formerly Bank One, has served well as the designated depository for tax collections for 2007 as well as in prior years.

THEREFORE BE IT RESOLVED that the Board of Trustees for the Charter Township of Bloomfield authorizes JPMorgan Chase Bank NA to be the depository for tax collections for 2008 taxes.

ITEM #14 Barton Farmhouse Resolution

The resolution, if adopted, indicates the Township’s intent to join with the City of Bloomfield Hills to form a non-profit corporation (501c3). Eventually, the Bloomfield Hills School District and the Bloomfield Historical Society will become part of this corporation.

There has been discussion of the Township and City contributing money, but no decisions have been made. The idea is to have enough funds in the corporation so that the City and Township would not need to contribute.

The resolution incorrectly listed the Bloomfield Historical Society as the Bloomfield Hills Historical Society.

MOTION by Barnett and SUPPORT by Roncelli to APPROVE the Barton Farmhouse Resolution with the Correction Regarding the Historical Society.

Resolution Establishing Intent to Create Non-Profit Corporation

WHEREAS, the Charter Township of Bloomfield (the "Township") has engaged in discussions with the Bloomfield Hills Board of Education (the "Board of Education"), the City of Bloomfield Hills (the "City") and the Bloomfield Historical Society ("Historical Society") regarding whether to accept the offer of the Barton Farmhouse located in the City for relocation to the Charles L. Bowers Farm owned by the Bloomfield Hills School District (the "School District"); and

WHEREAS, various meetings have been held by the above entities in order to discuss the raising of funds for anticipated costs as well as the various options to create an entity to own the Farmhouse once it is relocated to the School District property known as the Charles L. Bowers Farm; and

WHEREAS, the Bloomfield Hills Board of Education has accepted the offer of the Barton Farmhouse for relocation of the farmhouse to the Charles L. Bowers Farm provided there are no present or future financial obligations for moving, renovating, maintaining, operating or otherwise sustaining the farmhouse; and

WHEREAS, it is the intent of the Township to create a non-profit corporation and enter into an inter-governmental agreement with the City in order to maintain the structure and pay for anticipated expenses including, but not limited to, insurance and utilities. It is contemplated that the Historical Society and the School District would be involved in the governance of the non-profit corporation.

NOW, THEREFORE BE IT RESOLVED by the Township Board of the Charter Township of Bloomfield that the Township Board hereby indicates its intent and willingness to join in the formation of a non-profit corporation in conjunction with City of Bloomfield Hills and enter into an intergovernmental agreement with the City and to thereafter apply for 501C-3 designation by the Internal Revenue Service.

ITEM #15 Preliminary Review, 2008 Bloomfield Township Budget

By statute, the Township’s fiscal year is April 1st to March 31st. Each year the Township is required to present, to the Board, the preliminary budget. After modifications and meetings, the Board, at their first meeting in March, will hopefully adopt the final budget.

A complete copy of the 2008 Bloomfield Township Preliminary Budget is available in the Clerk’s Office.

ITEM #16 Tribute to Sherry Stefanes

MOTION by Savoie and SUPPORT by Barnett to ADOPT the Tribute to Sherry Stefanes.

THE CHARTER TOWNSHIP OF BLOOMFIELD

OAKLAND COUNTY, MICHIGAN

RESOLUTION

WHEREAS, Bloomfield Township adopts this Resolution to honor SHERRY STEFANES for her many years of dedicated service to the betterment of our community while serving on the Board of Trustees; and

WHEREAS, Sherry first served the residents of Bloomfield Township as a member of the Zoning Board of Appeals for two years; and

WHEREAS, Sherry was appointed to the Township Board in 1995 and elected in 1996, 2000 and 2004 and was the first female to serve the Bloomfield residents in this position; and

WHEREAS, Sherry, having been appointed to the Planning Commission in November 2002, served on this Board concurrently with her service on the Board of Trustees, working diligently and contributing her time to make Bloomfield Township a premier residential community in Oakland County; and

WHEREAS, Sherry’s history of community involvement extends well beyond the Township Boards, having served as the immediate past-president of the Birmingham Bloomfield Community Coalition, past president of the Bloomfield Village Board of Trustees, Albion College Alumni Board of Trustees and held leadership positions in the Women Officials’ Network, several Birmingham Public School’s parents groups, the Junior League of Birmingham, and the Pontiac Art Center and was former District Liaison for Shelley Goodman Taub, former State Representative, 40th District; and

WHEREAS, Sherry’s dedication to the public continues as she accepts a staff position with Jewish Vocational Services (JVS) and will work at Bloomfield Township’s Adult Day Services (ADS) as a Program Assistant; and

WHEREAS, we reluctantly relieve Sherry of her position on the Bloomfield Township Board of Trustees by accepting her resignation, effective January 1, 2008, but do so with the highest regard and esteem for her exceptional devotion and outstanding leadership abilities.

NOW, THEREFORE BE IT RESOLVED, that the members of the Board of Trustees and the residents of Bloomfield Township HONOR SHERRY STEFANES for her many years of service and contributions to making Bloomfield Township what it is today.

BE IT KNOWN to all reading this Resolution that it was adopted by the Township Board of Trustees on December 10, 2007, and included in the minutes as a permanent record.

ITEM #18 Public Comment

State Representative Chuck Moss, Former State Representative Shelley Goodman Taub and Oakland County Commissioners Karen Spector and David Potts were in attendance.

Commissioner Potts addressed the Board and audience. He stated that Oakland County has issued a hiring freeze, will have to find 45 million dollars over the next three years and that the rate of decline that was forecasted for the County has accelerated.
