BOARD OF TRUSTEES
MINUTES – MONDAY, NOVEMBER 26, 2007

PRESENT: Barnett, Buckley, Devine, Payne, Roncelli, Stefanes

Also present, Attorney Kristen Kolb

ABSENT: Savoie

Supervisor Payne welcomed the public and led the Pledge of Allegiance.

ITEM #1 Approved Board Minutes of November 13, 2007 and Study Session Minutes of November 15, 2007

ITEM #2 Final Site Plan Review – Township Senior Center

Jim Pappas, Project Architect, Fusco, Shaffer and Pappas, made the presentation.

The proposed design will provide an access point off Andover, directly across from the Echo Park subdivision entrance.

The Senior Services parking lot and the 48th District Court parking lot will be separated by a gate, which can be opened to allow for additional parking during special events. The gate would be controlled by the Senior Center.

The two-story building will be constructed on the south side of the Township campus. The lower level will serve as the active function area – fitness room, pool, and locker rooms. Patios will be on this level off the exercise rooms. The building will have a large hospital size elevator that would be able to accommodate a gurney, and an open staircase, which will provide access between floors.

The upper level (main floor) will have two central points of access and the pool area will be viewable from this floor. The "Meals on Wheels" program will also have a separate entrance with a kitchen warming area. There will be two large activity rooms that are designed for many uses. The senior day care will also be located on this level. The day care will have a separate entrance, with an activities area and outside area that will be secure. The building will contain many windows on the southern side, providing a view of the woods and wetlands. As many trees as possible will either remain in their same location or be relocated; this will also provide additional screening for Echo Park.

The anticipated start date for the project is February/March 2008. Construction will take approximately 12 to 18 months with completion anticipated for spring or fall 2009.

ITEM #3 Oakland County Mutual Aid Association – Fire Department

This association will provide assistance between community fire departments within Oakland County. The mutual aid would be for catastrophic events only, not everyday occurrences and a community may opt out if they can demonstrate they are busy. Each participating municipality and the County will sign an interlocal agreement with bylaws.

Members would be able to apply for grants under this association and may also withdraw with a 30-day notice. One benefit to becoming a member now is that dues will be $1000.00 this first year, $2000.00 the second year and $3000.00 for the third year and forward. New members coming into the program the third year and after would be required to pay $3000.00 each for the first and second years.

Oakland County will be the first county in Michigan to be part of this association called the Mutual Aid Box Alarm System (MABAS). Eventually the State of Michigan will become part of this agreement.

Supervisor Payne recognized Chief Chartier as being one of the leaders who put the agreement together.

MOTION by Devine and SUPPORT by Barnett to ADOPT the Oakland County Mutual Aid Association Resolution as Presented.

BLOOMFIELD TOWNSHIP

COUNTY OF OAKLAND, MICHIGAN

RESOLUTION APPROVING PARTICIPATION IN THE OAKLAND COUNTY MUTUAL AID ASSOCIATION AND EXECUTION OF THE INTERLOCAL AGREEMENT RELATING THERETO

At a regular meeting of the Township Board of Bloomfield Township, County of Oakland, State of Michigan, held on November 26, 2007, the following Resolution was moved, supported and adopted.

RECITALS:

WHEREAS, Bloomfield Township has the power, privilege and authority to maintain and operate a fire department providing fire protection, fire suppression, emergency medical services, technical rescue, hazardous incident response, and other emergency response services ("Fire Services");

WHEREAS, Fire Services can further be improved by cooperation between political subdivisions during times of public emergency, conflagration, or disaster;

WHEREAS, the Michigan Constitution of 1963, Article 7, § 28, and the Urban Cooperation Act of 1967, Act No. 7 of the Public Acts of 1967, Ex. Sess., being MCL 124.501, et seq. (the "Act"), permit a political subdivision to exercise jointly with any other political subdivision any power, privilege or authority which such political subdivisions share in common and which each might exercise separately;

WHEREAS, Bloomfield Township has been presented with an Interlocal Agreement Creating the Oakland County Mutual Aid Association ("Interlocal Agreement");

WHEREAS, the Interlocal Agreement establishes the Oakland County Mutual Aid Association as a separate legal entity and as a non-profit corporate body, pursuant to the Act, with the intention of further improving Fire Services through cooperative efforts between political subdivisions and achieving other related objectives stated in the Agreement; and

WHEREAS, Bloomfield Township desires to participate in the Oakland County Mutual Aid Association and enter into the Interlocal Agreement.

NOW, THEREFORE BE IT RESOLVED, that the Township Board of Bloomfield Township hereby authorizes the Township Supervisor and Township Clerk to enter into and execute the Interlocal Agreement Creating the Oakland County Mutual Aid Association on behalf of Bloomfield Township.

NOW, THEREFORE BE IT FURTHER RESOLVED, that the Township Board of Bloomfield Township hereby appoints Fire Chief Leo J. Chartier to serve as its designated member of the Oakland County Mutual Aid Association Board.

ITEM #4 Class ‘C’ Liquor License Request

The request is for the transfer of a Class ‘C’ Liquor License from Chevy’s Inc. to JS Holdings, LLC. This license has been in escrow since 2004. The transaction will only transfer license rights from one company to another; it will still be held within Bloomfield Township.

MOTION by Buckley and SUPPORT by Barnett to APPROVE the Class ‘C’ Liquor License Transfer from Chevy Inc. to JS Holdings, LLC.

ITEM #5 48th District Court 2008 Budget

Supervisor Payne advised the Board that the 48th District Court manages their affairs very well. This year they have less than a one percent increase over last year’s budget.

MOTION by Buckley and SUPPORT by Barnett to APPROVE the 48th District Court 2008 Budget.

ITEM #6 Approve Resolution for RCOC’s Traffic Control Order No. P 63-47-06, Installation of No Parking Signs on the North Side of Quarton Road from Forest Way to a Point Fifty Feet West

MOTION by Barnett and SUPPORT by Devine to APPROVE the Resolution for RCOC’s Traffic Control Order No. P 63-47-06.

RESOLUTION

WHEREAS, Oakland County has approved Traffic Control Order, P 63-47-06; and

WHEREAS, the approval pertains to the installation of no parking signs on the north side of Quarton Road from Forest Way to a point fifty feet west in Bloomfield Township,

NOW THEREFORE BE IT RESOLVED that the Bloomfield Township Board of Trustees approves the Traffic Control Order at this location.

ITEM #7 Close of S.A.D. 373 & S.A.D. 377

There are two sewer special assessment districts (SAD) that are now complete. Each has a surplus that will be refunded to the Township residents within these districts.

MOTION by Stefanes and SUPPORT by Buckley to APPROVE the Close of S.A.D. 373 and S.A.D. 377 and to Refund the Money to the Appropriate Residents.

ITEM #8 Distribution of Absent Voter Ballot Application Forms

At the meeting on November 13, 2007, the Board approved a resolution to continue the mass mailing for Township residents on the Permanent AV List. However, the State issued new guidelines on November 21, 2007.

Therefore, the Township Attorney recommends that any mailing of absentee voter applications be postponed unless it can be verified that confirmation of all names on the AV list requested that status. State Senator Pappageorge is currently presenting legislation, that if passed, will allow the mass mailing of absentee voter applications with the Board’s approval. If the legislation is not approved, a form could be sent to all voters on the list asking them to provide written verification to remain on the AV list. If the legislation does pass by December 1, 2007, the forms would not need to be mailed.

The Board decided to not act on the resolution before them, but instead made the following motion:

MOTION by Devine and SUPPORT by Buckley to APPROVE the Mailing of Absentee Voter Applications to Residents on the Permanent AV List if Legislation Passes AND to ALLOW the Election Commission to Make Decisions Relative to the Mailing of the Applications.

ITEM #9 Vacancy Policy

Trustee Stefanes officially resigned her position on the Bloomfield Township Board of Trustees effective January 1, 2008. She accepted a position with the Senior Services Center and did not want to cause any potential conflicts of interest by remaining on the Board.

Supervisor Payne, on behalf of the Board, wished Trustee Stefanes the best of luck. He thanked her for all she has done for the community and will continue to do with her work at the Senior Center.

By state statute, the Board may fill a vacancy by appointing someone. A process that has worked well when two previous seats became available will be utilized. The candidate will submit a letter of interest and resume along with a series of questions to the Township Supervisor by December 17, 2007. The Board, in a study session, will review all the responses received and reach a consensus. The position may not be filled by

January 1, 2008, but will be announced at the first Board meeting in January 2008.

MOTION by Barnett and SUPPORT by Roncelli to APPROVE the Vacancy Policy for the Bloomfield Township Board of Trustees.

MOTION by Devine and SUPPORT by Barnett to ACCEPT the Resignation of Trustee Stefanes Effective January 1, 2008.
