MINUTES – MONDAY, OCTOBER 22, 2007

PRESENT: Barnett, Buckley, Devine, Payne, Roncelli, Savoie, Stefanes

Supervisor Payne welcomed the public and led the Pledge of Allegiance.

ITEM #1 Approved Board Minutes of October 8, 2007 and Special Study Session with City of Bloomfield Hills and Bloomfield Hills School District Minutes of October 16, 2007

ITEM #2 General Obligation Unlimited Tax Bond, Series 2007

Terry Donnelly, Dickinson Wright PLLC, and Bobby Bendzinski, Bendzinski and Co., made the presentation.

The Notice of Sale for the Capital Building Program bonds was published in the Bond Buyer on October 12, 2007. The sale of the bonds occurred today at 11:30 a.m. with 24 firms making a bid - a large number in today’s market.

Bloomfield Township maintains the best Township rating (AA+) in the state of Michigan. Few cities have this rating and no other Townships per Standard & Poor’s Direct Rating. The Township has strong financial income and low overall debt burden, which demonstrates the dedication and commitment of all the elected officials.

Bendzinski recommended that the Board accept the resolution and award the bonds to the low bidder, Morgan Stanley and Co., Inc., with an interest rate of 4.42 percent. The closing has tentatively been scheduled for two weeks from today and the money should be in the bank by Tuesday, November 6, 2007.

MOTION by Barnett and SUPPORT by Stefanes to ACCEPT the Resolution and AWARD the Bonds to Morgan Stanley and Co., Inc. with an Interest Rate of 4.42 Percent.

RESOLUTION RECEIVING BIDS AND AWARDING BONDS

GENERAL OBLIGATION UNLIMITED TAX BONDS, SERIES 2007

WHEREAS, the letter from the Michigan Department of Treasury, dated October 9, 2007, granting qualified status to the Charter Township of Bloomfield (the "Township") pursuant to Act 34, Public Acts of Michigan, 2001, as amended, has been received and filed by the Township Clerk; and

WHEREAS, 11:30 a.m. on this day was the time set for the opening of proposals for purchase of the Township's $26,000,000 General Obligation Unlimited Tax Bonds, Series 2007 (the "Bonds"), as advertised in The Bond Buyer on October 12, 2007; and

WHEREAS, the Township Clerk has reported that the following proposals were received on or before 11:30 o'clock a.m., Eastern Daylight Time, on this day, which proposals were then duly opened, and as to interest rates, discount and premium were as follows:

NOW, THEREFORE, BE IT RESOLVED BY THE TOWNSHIP BOARD OF THE CHARTER TOWNSHIP OF BLOOMFIELD, AS FOLLOWS:

1. The fixing of this date as the date of sale of the Bonds, and the notice of such sale as published is hereby ratified and confirmed, in conformance with the Bond Resolution authorizing issuance of the Bonds adopted on September 10, 2007 (the "Bond Resolution").

2. The proposal of Morgan Stanley & Co., Inc. to purchase the Bonds at par less a discount of $115,154.99, plus accrued interest to the date of delivery, and bearing interest per annum as follows:

(same being the bid which produces the lowest true interest cost to the Township), be and the same hereby is accepted. All other bids are rejected and the bidding checks shall be returned to the unsuccessful bidders.

3. The Bonds shall be issued in accordance with the terms set forth in the Bond Resolution, bearing interest as set forth above.

All resolutions and parts of resolutions insofar as they may be in conflict herewith are hereby rescinded.

ITEM #3 Award Bid for 48th District Court Roof

Tom Trice, Public Works Director, made the presentation.

Per the lease agreement, the Township assumes responsibility for the repair and maintenance of the 48th District Court Building. . The roof of the courthouse is leaking and needs to be replaced. The job went out for bid on October 16, 2007 and four bids were received which met the required specifications.

Trice recommended that the Board accept the low bid of $127,100.00 and award the contract to Bloom Roofing Systems.

MOTION by Buckley and SUPPORT by Savoie to AWARD the 48th District Court Building Roof Replacement Contract to Bloom Roofing Systems with a Bid of $127,100.00.

ITEM #4 Introduction of Lot Split Request – 3705 Wabeek Lake Drive East (19-18-203-003)

Patti McCullough, Director of Planning and Building, made the presentation.

The property owners of 3705 Wabeek Lake Drive East are seeking approval to subdivide their property into two lots. The existing house is intended to remain on parcel A and parcel B will front Kirkway Road.

The Bloomfield Township Code of Ordinances, Article III, Division of Lots or Parcels, requires that the lot-split request meet certain standards. Both parcels meet all criteria.

Treasurer Devine requested that a No Variance be granted if this lot-split request is approved. Dennis Dickstein, representative for the applicant, replied that the request would be arranged.

MOTION by Barnett and SUPPORT by Stefanes to APPROVE the Introduction of the 3705 Wabeek Lake Drive East Lot-Split Request and to CALL for a Public Hearing on November 13, 2007.

ITEM #5 Award Bid for Westview Fire Station

Wayne Domine, Engineering & Environmental Director, made the presentation.

George W. Auch Company was hired to be the Construction Manager for the Capital Building Program. Contracts for all projects for the Capital Building Program will be between Auch and the company awarded the bid.

Bids for the fire station renovation were opened on October 3, 2007. Estimates for this reconstruction totaled $618,554.00, but actual bids totaled $599,986.00, so the project is under budget by $18,568.00. The project will start the beginning of November and the building should be completed by April 1, 2008.

MOTION by Devine and SUPPORT by Savoie to ACCEPT the Recommendations and AWARD the Contracts for the Westview Fire Station Renovation As Presented.

ITEM #6 Sewer Payback Agreement & Bill of Sale – 4970 Brookdale & 5005 Charing Cross

The property owners located at 4970 Brookdale and 5005 Charing Cross extended the public sanitary sewer to their properties at their own expense. The sewer payback agreement will guarantee that these residents are reimbursed when/if other property owners within the area desire to connect to the system. The bill of sale will convey ownership of this sewer to the Township for operation and maintenance in the sum of $1.00.

MOTION by Stefanes and SUPPORT by Buckley to APPROVE the Sewer Payback Agreement and Bill of Sale for the Brookdale Road Sanitary Sewer Extension.

ITEM #7 Introduction of Ordinance 594, South Hills of Bloomfield Manor Traffic Enforcement

MOTION by Barnett and SUPPORT by Savoie to ACCEPT the Introduction of Ordinance 594, South Hills of Bloomfield Manor Traffic Enforcement.

ORDINANCE NO. 594

SOUTH HILLS OF BLOOMFIELD MANOR MOTOR VEHICLE CODE

AND 2002 UNIFORM TRAFFIC CODE ADOPTION ORDINANCE

An Ordinance to PROVIDE FOR THE ENFORCEMENT OF THE MICHIGAN VEHICLE CODE (MVC), MCL 257.1, ET SEQ., AS AMENDED, NOW AND IN THE FUTURE, AND FOR THE ADOPTION OF THE 2002 EDITION OF THE UNIFORM TRAFFIC CODE (UTC) FOR THE PURPOSE OF REGULATING TRAFFIC AND MOTOR VEHICLES ON THE PRIVATE STREETS WITHIN THE SOUTH HILLS OF BLOOMFIELD MANOR CONDOMINIUM.

THE CHARTER TOWNSHIP OF BLOOMFIELD ORDAINS AS FOLLOWS:

Section 1 of Ordinance

Article III, of Chapter 36, Traffic and Vehicles, is hereby amended to add Section 36-63 as follows:

Sec. 36-63. South Hills of Bloomfield Manor Condominium

Any person violating the provisions of the 2002 Uniform Traffic Code and the Michigan Vehicle Code on the private roads in the South Hills of Bloomfield Manor Condominium, in Section 2, Bloomfield Township, shall be subject to and liable for the penalties therefore.

Section 2 or Ordinance

Except as amended in this Ordinance, the Ordinances of the Charter Township of Bloomfield, including the Motor Vehicle Code, as amended, shall remain in full force and effect.

Section 3 of Ordinance

If any provision of this Ordinance is held invalid, the invalidity does not affect other provisions that can be given effect without the invalid provision. All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this Ordinance takes effect are saved and may be consummated according to the law when they were commenced.

Section 4 of Ordinance

A summary of this Ordinance shall be published in accordance with the Charter of the Charter Township of Bloomfield and this Ordinance shall become effective immediately upon the publication in the manner proscribed by law.

It is certified that the foregoing Ordinance was duly adopted by the Township Board of the Charter Township of Bloomfield at a meeting duly called and held on the _____ day of ________________, 2007.

ITEM #8 Approve Resolution for RCOC’s Traffic Control Order No. TP 283-03-07, Prohibition of left turns entering and exiting the westerly driveway of the Unity Center of Bloomfield

MOTION by Devine and SUPPORT by Buckley to APPROVE the Resolution for the RCOC’s Traffic Control Order No. TP 283-03-07.

RESOLUTION

WHEREAS, Oakland County has approved Traffic Control Order No., TP 283-03-07; and

WHEREAS, the approval pertains to the prohibition of left turns entering and exiting the westerly driveway of the Unity Center of Bloomfield in Bloomfield Township,

NOW THEREFORE BE IT RESOLVED that the Bloomfield Township Board of Trustees approves the Traffic Control Order at this location.

This amendment pertains to the election records only. It clearly outlines how long ballots must be retained.

AMENDMENT TO RETENTION AND DISPOSAL SCHEDULE FOR

TOWNSHIPS, GENERAL SCHEDULE #10 – ELECTIONS RECORDS

BE IT RESOLVED that the Bloomfield Township Board of Trustees approves General Schedule #23 – Elections Records. This Retention and Disposal Schedule covers records that are used to administer elections. In addition, this schedule supersedes General Schedule #10 (MCL 399.5 and 750.49) —Townships: Elections Department only and meets the administrative, legal, fiscal and archival requirements of the State of Michigan. The document was approved by the following: Bureau of Elections; Department of History, Arts and Libraries, Records Management Services; and the Department of History, Arts and Libraries, Archives of Michigan.

ITEM #11 Public Comment

Charles Soberman, 3727 Franklin, spoke to the Board regarding safety issues on Franklin Rd. The Board approved drafting a resolution in support of a lower speed limit and a no passing zone.

MOTION by Barnett and SUPPORT by Devine to APPROVE a Recommendation to the Road Commission for Oakland County Regarding Franklin Road.

BLOOMFIELD TOWNSHIP RESOLUTION

WHEREAS, Charles Soberman, 3727 Franklin Road, a Bloomfield Township resident, has brought his, as well as other Franklin Road homeowners, concerns for the security and well-being of vehicles and pedestrians on Franklin Road to the attention of the Bloomfield Township Board of Trustees; and

WHEREAS, the Board concurs with Mr. Soberman and recognizes the need for safety on Franklin Road.

NOW THEREFORE BE IT RESOLVED that the Bloomfield Township Board of Trustees encourages the Road Commission for Oakland County to reduce the speed limit and approve a "NO PASSING" zone on Franklin Road between Telegraph and Long Lake Roads.
