MINUTES – MONDAY, JULY 23, 2007
PRESENT: Barnett, Buckley, Devine, Payne, Roncelli, Savoie,

Also present, Attorney William Hampton
ABSENT: None
Supervisor Payne welcomed the public and led the Pledge of
Allegiance.
ITEM #1 Approved Board Minutes of July 9, 2007
ITEM #2 Consider Approval of Fireworks Permit for Les
Gold, 3701 Durham Ct.
Mr. Gold has held this display annually for many years and
the Township has not received complaints. He has met all
current Township requirements for a fireworks permit. This
year, the display is scheduled for August 4, 2007 at dusk.
MOTION by Barnett and SUPPORT by Buckley to APPROVE the
Fireworks Permit for Les Gold, 3701 Durham Ct.

Stefanes
NAYS: None
RESOLUTION DECLARED ADOPTED.

ITEM #3 Consider Approval of Fireworks Permit for Tom
Celani, 2600 Turtle Lake Dr.
Mr. Celani has met all current Township requirements for a
fireworks permit. The display is scheduled for August 4, 2007
at dusk.
MOTION by Savoie and SUPPORT by Barnett to APPROVE the
Fireworks Permit for Tom Celani, 2600 Turtle Lake Dr.

ITEM #4 1485 Club Dr. Lot Split (Tabled from June 25,
2007 Board Meeting)
This request was originally brought before the Board on
June 11, 2007. At that time, the proposed parcels did not
conform to the Township’s Lot Split Ordinance requirements.
The Township has received no changes or modifications.
Supervisor Payne, Attorney Hampton and Patti McCullough,
Director of Planning and Building, met with the applicant,
Richard Merlini, the week of July 16, 2007, and he indicated
that he was going to withdraw his petition. Merlini was
advised that the withdrawal must be in writing. The Township
has received no written request.
MOTION by Savoie and SUPPORT by Barnett to DENY the 1485
Club Drive Lot Split Request.

Stefanes

ITEM #5 Consider Approval of Final Site Plan for L A
Fitness/C. Rose, 2050 Telegraph Rd.
The site is located on the southwest side of Telegraph
Road, north of Square Lake Road, and is the former location of
Frank’s Nursery. Carl Rose, property owner, is seeking
approval to redevelop the site into a 45, 000 square foot
health club.
The site is zoned B-3, General Business. Per the Township
Zoning Ordinance, the proposed health club is considered to be
a permitted use for an area zoned B-3.
Rose is also requesting that the north portion of the lot
be split and added to 1976 Telegraph Road for future expansion
opportunities for Carl’s Golfland.
Mr. Rose stated that if all approvals can be obtained, he
hopes to have the health club open for business by March 2008.
MOTION by Savoie and SUPPORT by Devine to APPROVE the Final
Site Plan for L A Fitness/C. Rose, 2050 Telegraph Road,
Subject to Approval of the Lot Split Request, Easements and
Parking Issues.
MOTION by Buckley and SUPPORT by Stefanes to APPROVE the
Lot Split Public Hearing for August 13, 2007.

ITEM #6 Temporary Depository Agreement Between Charter
Twp. of Bloomfield & Bloomfield Twp. Library
Board members were given a tour of the library’s new site.
In their archive section, the library would like to display
some Township history items. The display would be for a term
of two months (August and September). If the Board and the
library would like to extend the display, a new agreement
would need to be signed.
MOTION by Barnett and SUPPORT by Buckley to ACCEPT the
Temporary Depository Agreement Resolution.
RESOLUTION
TEMPORARY DEPOSITORY AGREEMENT BETWEEN THE CHARTER TWP. OF
BLOOMFIELD AND THE BLOOMFIELD TWP. LIBRARY
WHEREAS, public records are the property of the People of
the State of Michigan. As a result, Michigan governmental
agencies such as Bloomfield Township are responsible for
ensuring that the public records they create and receive while
conducting public business are retained and destroyed in
accordance with Michigan law and;
WHEREAS, local government agencies such as the Township
cannot relinquish legal custody of their public records,
however, under certain conditions, a local governmental agency
may deposit (transfer physical custody of) its physical
records with an alternative institution such as a library that
is willing to store and provide access to the records and;
WHEREAS, while a local governmental agency such as the
Township cannot transfer legal custody of public records to
another institution, there may be circumstances upon which it
is desirable to transfer physical custody. In such instances,
the local governmental agency should execute a depository
agreement with the alternative institution that specifies the
terms of the depository agreement.
NOW, THEREFORE, be it resolved by the Charter Township of
Bloomfield that the Township enter into a temporary depository
agreement for the period July 30, 2007 through September 30,
2007 with the Bloomfield Township Library to transfer physical
custody of the documents set forth in the attached Attachment
A.
Be it further resolved that the Supervisor of the Township
be authorized to sign a temporary public records depository
agreement with the Bloomfield Township Library in accordance
with the resolution.

ITEM #7 William Hampton, Township Attorney,
Professionalism Award
The Board officially recognized Attorney Hampton and
congratulated him on a job well done.
ITEM #8 Approve Payroll and Vouchers
MOTION by Barnett and SUPPORT by Stefanes to APPROVE
payroll and vouchers A002477-A002503; B016741-B016935;
E002330-E002345 totaling $6,217,749.09.

ITEM #9 Public Comment
David Patton, 2953 Heron Place, spoke to the Board
regarding Agenda Item #4.
The Board recognized the following members of the audience:
Brendan Buckley, 9 years old, Trustee Buckley’s son.
Marcia Gershenson, Oakland County Commissioner.
Robert Jones, Bloomfield Township resident.
Geof Gaudard, Deputy Chief of Police, reviewed areas of
interest on the 2006 Annual Report.
Trustee Stefanes stated that there is a Bloomfield Township
identity problem. The Township is consistently referred to as
Bloomfield Hills and avenues to correcting the dilemma need to
be examined.
The cable renewal with Birmingham was discussed by the
Board in regards to the hard work by Community Relations
Director, Leslie Helwig, who obtained the contract.

General Schedule #10, MCL 399.5, the audio recordings of Board
