Mr. Gyarmati has held this display for a number of years.
There have been no complaints regarding this event, but there
has been some as to firecrackers and other explosives being
set off afterwards.

ITEM #4 Award Contract for 2007 Cranbrook Road
Reconstruction – Presented by Wayne Domine
In May 2006, the Board authorized the use of tri-party
funds to reconstruct Cranbrook Road at a cost of
$1,360,000.00. Since last year, the cost to complete the
project has increased to $1,539,000, with the Township’s share
being $478,000.00.
Domine recommended acceptance of the low bid from Florence
Cement Company to complete the work for this project.
Once the tri-party agreement is signed, the work will begin
tentatively in July 2007, with final restoration being
completed in October 2007.
MOTION by Devine and SUPPORT by Buckley to AWARD the
Contract for the 2007 Cranbrook Road Reconstruction to
Florence Cement Company and to AUTHORIZE the Increase in
Expenditures for this Project.

ITEM #5 Award Contract for Environmental Assessment –
Presented by Wayne Domine
Proposals were secured from four consulting firms to
conduct Phase 1 of the Environmental Assessment Survey. This
survey will assess the potential for hazardous materials for
the Capital Building Program.
Domine recommended Huron Consultants to perform the work
with a budget not to exceed $12,470.00.

Environmental Assessment Survey for the Capital Building
Project to Huron Consultants with a Budget NOT to Exceed
$12,470.00.

Establish Permanent Lawn Ground Cover for Construction
Projects
This Ordinance was introduced to the Board at their last
meeting on May 14, 2007.

PERMANENT LAWN GROUND COVER
AN ORDINANCE TO REQUIRE THE ESTABLISHMENT OF PERMANENT LAWN
GROUND COVER AT THE TIME OF ISSUANCE OF A CERTIFICATE OF
OCCUPANCY OR THE POSTING OF A FINANCIAL GUARANTEE
THE TOWNSHIP OF BLOOMFIELD ORDAINS:
Section 1.
Article XVII Administration, Section 1702. Certificate of
Occupancy, of the Township Zoning Ordinance No. 265, as
amended, is hereby amended to add subsections 2 b, c and d to
read as follows:
SECTION 1702. CERTIFICATE OF OCCUPANCY:
No land, building, structure, or part thereof shall be
occupied by or for any use for which a building permit is
required by this Ordinance unless and until a Certificate of
Occupancy shall have been issued for such new use. The
following shall apply in the issuance of any certificate:
1. Certificates Not to be Issued.
No Certificates of Occupancy pursuant to the Building
Code of the Township of Bloomfield shall be issued for any
building, structure or part thereof, or for the use of any
land, which is not in accordance with all the provisions
of this Ordinance.
2. Certificate Required.
No building or structure, or parts thereof, which is
hereafter erected or altered, shall be occupied or used or
the same caused to be occupied or used, unless and until a
Certificate has been issued and the following requirements
complied with and approved by the Building Inspector.
a. Prior to the issuance of a Certificate of
Occupancy, a grading certificate prepared, signed, and
sealed by a registered professional civil engineer or
a registered professional land surveyor shall be
submitted to the Building Inspector. The grading
certificate shall be submitted in duplicate, attesting
to the fact that the site has been constructed and
graded in accordance with the approved grading plan.
The grading certificate shall also state that the
permanent irons at each lot corner are in evidence,
and that the drainage pattern is in accordance with
the grading plan as approved at the time of issuance
of the building permit.
b. If, at the completion of the building project,
and if for reasons beyond the control of the
applicant, such as when weather conditions make finish
grading unfeasible to be completed, the applicant
shall, in lieu of a grading certificate, post a
financial guarantee with the Township in the form of a
cash bond. This alternative may be used at the
discretion of the Building Inspector, and the bond
shall be in an amount set by the Building Inspector to
insure completion of the finish grading and the
submission of such certificate within nine (9) months,
or at the next opportunity. In such case, a Temporary
Certificate of Occupancy may be issued and the date
for completion of grading shall be indicated on the
Temporary Certificate of Occupancy or its related
documents.
c. Permanent lawn grass ground cover is installed
by seeding or sodding, pursuant to written
specifications of seed, sod, soil and time of planting
approved by the Building Inspector. Permanent ground
cover other than lawn grass may be substituted in rear
yards, subject to approval by the Building Inspector.
d. If the above prescribed final grading is not
completed, and the above prescribed ground cover is
not established and thriving at the time of
application for the Certificate of Occupancy, the
applicant shall post a financial guarantee with the
Township in the form of a cash bond in an amount
estimated by the Building Inspector necessary to
ensure completion thereof within nine (9) months. All
temporary erosion control measures must remain in
place until such time that the ground cover is
established.
A Certificate of Occupancy shall also be required for the
change of any existing principal use or tenancy of a building
or land to another principal use or tenancy, excepting
residential tenancy.
Section 2. Repealer.
All Ordinances or parts of Ordinances in conflict herewith
are hereby repealed only to the extent necessary to give this
Ordinance full force and effect.
Section 3. Savings.
All proceedings pending and all rights and liabilities
existing, acquired or incurred at the time this Ordinance
takes effect, are saved and may be consummated according to
the law when they were commenced.
Section 4. Severability.
If any section, clause or provision of this Ordinance shall
be declared to be unconstitutional, void, illegal or
ineffective by any Court of competent jurisdiction, such
section, clause or provision declared to be unconstitutional,
void or illegal shall thereby cease to be a part of this
Ordinance, but the remainder of this Ordinance shall stand and
be in full force and effect.
Section 5. Effective Date.
The provisions of this Ordinance are hereby ordered to take
effect immediately upon publication in the manner prescribed
by law.
Section 6. Adoption.
This Ordinance is hereby declared to have been adopted by
the Township Board of the Charter Township of Bloomfield at a
meeting thereof duly called and held on the 29th day of May,
2007, and ordered to be given publication in the manner
prescribed by law.

ITEM #7 Introduction of Ordinance 586, Code of
Ordinances Adopting Ordinance
It has been 22 months since the Codification of Ordinances
contract was signed. All ordinances will be codified up to
Ordinance #582, adopted March 2007, and will be available on
the Bloomfield Township website within the next two weeks.
Approximately two times per year there will be supplements to
this codification; to include new ordinances that have been
adopted.
The Board acknowledged Jan Roncelli, Clerk, and Tina
Barton, Deputy Clerk, for their coordination of this massive
undertaking.
Attorney Kolb stated that this ordinance would repeal all
ordinances that are not up-to-date.

CODE OF ORDINANCES ADOPTING ORDINANCE
AN ORDINANCE ENACTING A CODE OF ORDINANCES FOR THE CHARTER
TOWNSHIP OF BLOOMFIELD, WHICH INCLUDES REPEALING, REVISING,
AMENDING, RESTATING, CODIFYING, AND COMPILING CERTAIN EXISTING
GENERAL ORDINANCES OF THE CHARTER TOWNSHIP OF BLOOMFIELD;
PROVIDING FOR A PENALTY FOR VIOLATION THEREOF; PROVIDING FOR
THE MANNER OF AMENDING SUCH CODE; AND, PROVIDING WHEN SUCH
CODE AND THIS ORDINANCE SHALL BECOME EFFECTIVE.
THE CHARTER TOWNSHIP OF BLOOMFIELD ORDAINS:
Section 1 of Ordinance. Purpose and Intent.
The present general and permanent ordinances of the
Township are inadequately arranged and classified and are
insufficient in form and substance for the complete
preservation of the public peace, health, safety, and general
welfare of the municipality and for the proper conduct of its
affairs. The State of Michigan legislation empowers and
authorizes the Township to revise, amend, restate, codify, and
compile any existing ordinances and all new ordinances not
heretofore adopted or published and to incorporate such
ordinances into one ordinance in book form. The Township Board
has authorized a general compilation, revision, and
codification of the ordinances of the Township of a general
and permanent nature and publication of such ordinance in book
form. It is necessary to provide for the usual daily operation
of the municipality and for the immediate preservation of the
public peace, health, safety, and general welfare of the
municipality that this ordinance take effect at an early date.
Section 2 of Ordinance. Short Title.
This Ordinance shall be known as the "Code of Ordinances
Adopting Ordinance" and may be so cited.
Section 3 of Ordinance. Adoption of Code of Ordinances.
The general ordinances of the Township as revised, amended,
restated, codified, and compiled in book form attached hereto
and incorporated herein, are hereby adopted as and shall
constitute the "Code of Ordinances of the Charter Township of
Bloomfield, Michigan."
Such Code of Ordinances as adopted in Section 1 shall
consist of the following Chapters:

Section 4 of Ordinance. Penalty.
Whenever in this Code or any ordinance of the Township an
act is prohibited or is made or declared to be a misdemeanor
or a municipal civil infraction, or whenever in this code or
any ordinance the doing of any act is required or the failure
to do any act is declared to be a misdemeanor or municipal
civil infraction, the violation of any such provision by any
person shall, upon conviction of a misdemeanor, be punished by
a fine not exceeding $500.00 or imprisonment for a term not
exceeding 90 days, or both, except whenever a specific is
otherwise provided. Whenever any such violation shall
constitute a municipal civil infraction, a finding of
responsibility shall be punished by a civil fine not exceeding
$500.00, except whenever a specific penalty is otherwise
provided.
Each act of violation and each day upon which any such
violation shall occur shall constitute a separate offense. The
penalty provided by this section, unless another penalty is
expressly provided, shall apply to the amendment of any Code
section, whether or not such penalty is reenacted in the
amendatory ordinance. In addition to the penalty prescribed
above, the Township may pursue other remedies such as
abatement of nuisances, injunctive relief and revocation of
licenses or permits.
Section 5 of Ordinance. Code Additions or Amendments.
Additions or amendments to the Code when passed in such
form as to indicate the intention of the Township Board to
make the same a part of the Code shall be deemed to be
incorporated in the Code, so that reference to the Code
includes the additions and amendments.
Section 6 of Ordinance. Later Ordinances.
Ordinances adopted after March 26, 2007 that amend or refer
to ordinances that have been codified in the Code shall be
construed as if they amend or refer to like provisions of the
Code.
Section 7 of Ordinance. Repealer.
All prior ordinances pertaining to the subjects treated in
such Code of Ordinances shall be deemed repealed from and
after the effective date of this ordinance except as they are
included and reordained in whole or in part in such Code.
Section 8 of Ordinance. Savings.
All proceedings pending and all rights and liabilities
existing, acquired or incurred at the time this ordinance
takes effect are saved and may be consummated according to the
law in force when they were commended.
Section 9 of Ordinance. Prior Ordinances Not Revived.
The repeal provided for in Section 4 hereof shall not be
construed to revive any ordinance or part thereof that has
been repealed by a subsequent ordinance that is repealed by
this ordinance.
Section 10 of Ordinance. Severability.
Should any section, subdivision, clause, or phrase of this
Ordinance be declared by the courts to be invalid, the
validity of the ordinance as a whole, or in part, shall not be
affected other than the part invalidated.
Section 11 of Ordinance. Effective Date.
This ordinance shall take effect immediately upon
publication in the manner prescribed by law.

ITEM #8 Introduction of Ordinance 587, Solicitation
Amendment, and Resolution
This ordinance and resolution is in response to residential
concern with solicitors in the Township. It proposes that the
solicitor must apply for a permit, wear an identification
badge, and pay an issuance fee.
Board members made suggestions regarding the badges such as
the Township seal/logo being added, making the "Solicitation
License" title larger, and putting the Clerk’s office phone
number on the back so that residents may call to verify.

Introduction of Ordinance 587, Solicitation Amendment.

SOLICITATION AMENDMENT
AN ORDINANCE TO AMEND ORDINANCE NO. 551, THE TOWNSHIP
SOLICITATION ORDINANCE, TO REGULATE ORGANIZATIONS AND PERSONS
SOLICITING AND, TO REQUIRE REGISTRATION, DISCLOSURE OF
INFORMATION, LICENSING, INCLUDING AN ADMINISTRATIVE PROCESSING
FEE AND/OR LICENSE FEE AND AN IDENTIFICATION CARD BEFORE
SOLICITING, AND TO EXEMPT QUALIFIED VETERANS.
THE CHARTER TOWNSHIP OF BLOOMFIELD ORDAINS:
Section 1. Purpose
The Township Board having determined that it is in the best
interest of Bloomfield Township to enact an Ordinance
regulating organizations and persons soliciting in the
Township, the enactment of said Ordinance being necessary to
promote and protect the public safety of those persons
soliciting as well as to protect the public safety, protect
residents’ privacy, as well as preventing fraud as to those
persons in the Township being solicited.
Section 2. Definitions
The following words and terms shall have the following
definitions for the purposes of this Ordinance.
A. Person: An individual, organization, group,
association, partnership, corporation, trust, business
entity or any combination of the above.
B. Soliciting Material: Printed or similar materials,
including but not limited to the labels, posters, brochures,
flyers, pamphlets, magazines, booklets, books and other like
items used in the course of and for the purposes of
soliciting.
C. Solicitor:
(1) A person who solicits when traveling either by
foot, wagon, automobile, motor truck, or other means of
conveyance from place to place, from house to house or
from street to street.
(2) A person who hires, leases, uses or occupies any
building, structure, hotel, room, shop or any other place
for the sole purpose of exhibiting samples or soliciting
material and taking orders for future delivery.
(3) The word solicitor shall include but not be limited
to the words canvassers, peddler, and hawker.
D. Solicits: The act of offering or attempting to offer
wares, merchandise, services, items of personal property,
real property, either for immediate or future delivery; or
the act of seeking or attempting to seek contributions
either in money or services for charitable or commercial
purposes.
Section 3. License Required
No person shall be a solicitor and/or solicit in Bloomfield
Township without first obtaining a license therefore. An
application for a license shall be made to the Township Clerk.
In the event that the application is made by an organization,
group, association, partnership, corporation, trust, business
entity or any combination of the above, an application must be
made for each agent or employee who shall be engaging in the
act of soliciting.
Section 4. License Application
A license application filed hereunder shall furnish the
following information:
(A) Name and description of the applicant.
(B) Permanent home address and full local address of the
applicant.
(C) A brief description of the nature of the solicitation
contemplated.
(D) If the applicant is an employee, the name and address
of the employer, together with the credentials establishing
the exact employer/employee relationship.
(E) The length of time the applicant intends to solicit.
(F) The place where the wares, merchandise, services,
items of personal property or real property are located,
manufactured or produced, where such items are located at
the time said application is filed and the proposed method
of delivery.
G) One photograph of the applicant, said photograph being
from the applicant’s driver’s license, and a copy of said
driver’s license to be attached to the applicant’s
application. If the applicant does not have a driver’s
license, the photograph may be from a state identification
card, and a copy of said state identification card shall be
attached to the applicant’s application. In the event that
the application does not have a driver’s license or a state
identification card, then the application shall submit a
photograph which shall be at least 2" x 2" and show the head
and shoulders of the applicant in a clear and distinguishing
manner.
(H) The applicant’s social security number.
(I) A statement as to whether or not the applicant has
been convicted of any felony, misdemeanor or violation of
any municipal ordinance, the nature of the offense and the
punishment or penalty assessed therefore.
Section 5. Administrative Fee and/or License Fee
There shall be a reasonable administrative processing fee
and/or license fee required by the Township to obtain a
solicitor’s license from the Township. The administrative
processing fee and/or license fee shall be declared by
resolution of the Township Board.
Section 6. Issuance, Possession, and Presentation of
License
Upon approval of the license application, the Township
Clerk shall issue a license and license identification card
including the name, address, and photo of the licensed person.
The licensed person shall visibly display on their person at
all times the license identification card when conducting
activities permitted by the license. The licensed person must
produce and present the license identification card upon the
request of any Township official or person being solicited.
Failure to visibly display on their person and/or present the
license identification card may result in revocation of the
license subject to Section 7. Failure to visibly display on
their person and/or present the license identification card
may result in penalty imposed under Section 11.
Section 7. License Revocation
A license may be suspended or revoked by the Township Board
for violation of this Ordinance after reasonable notice and
opportunity to be heard. The Township Board may suspend on an
emergency basis, without hearing, any license issued to the
solicitor when the Township Board specifies in the notice of
emergency suspension, the reasons and grounds indicating the
violation of this Ordinance which constitutes the emergency.
The notice shall set forth that within 48 hours, at a
designated time and place, a hearing shall be held on whether
the license shall be permanently suspended or revoked. The
solicitor may show compliance with the requirements of this
Ordinance and shall have the burden of adducing the evidence.
Section 8. Prohibited Activities
The following acts or activities shall be prohibited:
(A) Fixed stands prohibited. No solicitor shall stop or
remain in one place upon any street, alley or public place.
(B) Prohibited areas. No solicitor shall obstruct any
street, alley, sidewalk or driveway.
(C) Litter. No solicitor shall litter any street, alley,
sidewalk, driveway, or private property in the Township.
(D) Curb service prohibited. No solicitor shall operate
or maintain any stand, vehicle, store or place of
solicitation on or near any highway. No solicitor shall be
permitted to use the streets, alleys, lanes or public places
of the Township for soliciting or to use any stands, stores
or other places of transaction in any manner that requires
the person wishing to participate in a transaction, when
engaged in the transaction, to stand within the limits of
the streets, highways, alleys or public places of the
Township.
(E) Prohibition of entry upon private property expressly
requesting no solicitation. No solicitor shall enter upon
and/or call upon a place of residence or business within
Bloomfield Township after having been expressly notified by
the occupant of the place of residence or business that no
solicitation is desired, or if the place of residence or
business visibly displays on its property and/or premises a
sign indicating "no soliciting", "no solicitation" and/or
other language specifically conveying the message that no
soliciting is desired.
(F) Prohibition of creation of nuisance. No solicitor
shall threaten or annoy any resident of the Township in the
course of their solicitation or in any way engage in any
conduct which is or would tend to create a nuisance.
Section 9. Hours of Operation
Soliciting may take place within the Township between the
hours of 11:00 a.m. in the forenoon and 7:00 p.m. in the
evening while daylight savings time is in effect and from
11:00 a.m. in the forenoon and 5:00 p.m. in the evening when
daylight savings time is not in effect.
Section 10. Exempt Persons
The following persons shall be exempt from the licensing
requirements, administration and/or license fee, and license
identification card requirements of this Ordinance, but shall
be subject to the other provisions herein:
(A) Persons engaged in the occupation of sale or of
distribution of newspapers.
(B) Persons engaged in soliciting on foot within one-half
mile of their residence.
(C) Persons engaged in non-commercial, religious
canvassing.
(D) Persons engaged in the distribution of handbills,
signed or unsigned, political or otherwise.
(E) Persons duly licensed under Act 359 of 1921, MCL
35.441, et seq. (Qualified Veterans).
Section 11. Penalty
Any person or persons violating any of the provisions of
this Ordinance shall be guilty of a misdemeanor and upon
conviction thereof, shall be punished by a fine of not more
than $500.00 plus costs of prosecution or by imprisonment for
not more than 90 days or by both fine and costs and
imprisonment in the discretion of the Court.
Section 12. Repealer
All Ordinances or parts of Ordinances in conflict herewith
are hereby repealed only to the extent necessary to give this
Ordinance full force and effect
Section 13. Severability
Should any section, subdivision, clause, or phrase of this
Ordinance be declared by the Courts to be invalid, the same
shall not affect the validity of the Ordinance as a whole or
any part thereof, other than the parts so invalidated.
Section 14. Savings
All proceedings pending and all rights and liabilities
existing acquired or incurred at the time this Ordinance takes
effect, are saved and may be consummated according to the law
enforced when they are commenced.
Section 15. Effective Date
The provisions of this Ordinance are hereby ordered to take
effect thirty days after publication in the Birmingham
Eccentric, a newspaper circulated within the Township.
Section 16. Adoption
This Ordinance is hereby declared to have been adopted by
the Township Board of the Township of Bloomfield in a meeting
thereof duly held and called on the ____ of June, 2007.
MOTION by Devine and SUPPORT by Buckley to ACCEPT the
Introduction of the Resolution for Ordinance 587.
RESOLUTION
WHEREAS, the Township Board of the Charter Township of
Bloomfield has adopted Ordinance No.587, an ordinance to amend
Ordinance 551, the Township Solicitation Ordinance; and
WHEREAS, pursuant to said amended ordinance, Section 5, the
Township shall impose a reasonable administrative processing
fee and/or license fee for applicants to obtain a solicitors
license from the Township; and
WHEREAS, pursuant to Section 5, the administrative
processing fee and/or license fee shall be declared by
resolution of the Township Board;
NOW, THEREFORE BE IT RESOLVED by the Township Board of the
Charter Township of Bloomfield that an administrative
processing fee and/or license fee shall be established in the
amount of Twenty ($20.00) Dollars per person.

ITEM #9 14 Mile Road Surfacing
Jon Stoppels, Franklin Village Manager, approached
Supervisor Payne as to the possibility of the Township
participating in placing a new gravel surface on 14 Mile Road
from Franklin Road to Inkster Road. The cost would be split
between municipalities with each paying approximately
$6000.00.
MOTION by Stefanes and SUPPORT by Savoie to APPROVE the 14
Mile Road Surfacing.
Be It Resolved that the Bloomfield Township Board of
Trustees approves the joint project with the Village of
Franklin and the Road Commission for Oakland County for
placing new gravel on 14 Mile from Franklin to Inkster and
will fund the cost of material with the Village of Franklin up
to $6000.00.

MOTION by Buckley and SUPPORT by Roncelli to APPROVE
payroll and vouchers A002381-A002405; B016043-B016228;
E002282-E002292 totaling $1,373,139.59.

ITEM #11 Public Comment
No Public Comment was made.
Supervisor Payne advised the Board that the City of
Bloomfield Hills had contacted the Township as to the
possibility of the two Boards meeting in an informal setting
to discuss common issues. The Board discussed whether the
meeting would need to be posted. Attorney Kolb suggested that
it would be best to post the meeting as a study session.
Trustee Stefanes stated that the sidewalk on Lahser Road,
south of Lahser High School to Quarton Road, was amazing. The
Board agreed.
As approved in the budget, the Deferred Compensation Plan
and pay increase that will be retroactive to April 1, 2007 for
the Trustees was reiterated.
ITEM #12 Michigan Township Association (MTA) and Oakland
County Clerk Advocacy Against House Bill 4780-4788
MOTION by Stefanes and SUPPORT by Barnett to APPROVE the
Resolution Supporting MTA and Ruth Johnson, Oakland County
Clerk, Advocacy Against House Bill 4780 – 4788.
RESOLUTION TO OPPOSE MICHIGAN HOUSE BILL 4780 – 4788
MICHIGAN TOWNSHIP SERVICES CONSOLIDATION ACT
WHEREAS, House Bill 4780 – 4788 advocates consolidation of
election duties by the Clerk, assessing duties of the
Supervisor, and tax collection duties of the Treasurer in
rural Townships to be assumed by the County; and
WHEREAS, this bill affects rural Townships with populations
of 10,000 or less and rural Townships with populations of
10,000 or more, but less than 20,000 which do not provide for
and make available fire, police on a 24-hour basis either
through contracting for or directly employing personnel, water
to 50% or more of its residents, and sewer services to 50% or
more of its residents; and
WHEREAS, this bill strips away local authority from rural
Townships which comprise more than 90% of the Townships in
Michigan; and
WHEREAS, the proposed cost-saving measure could result in
higher costs to taxpayers. More than 50 percent of the state’s
population lives in townships; yet townships spend one-eighth
the amount of cities on providing services to residents; and
WHEREAS, the Michigan Township Association (MTA) and the
Oakland County Clerk, Ruth Johnson, have voiced opposition to
House Bill 4780 – 4788,
NOW THEREFORE BE IT RESOLVED that the Bloomfield Township
Board of Trustees joins with the MTA and Oakland County Clerk
Ruth Johnson to OPPOSE House Bill 4780 – 4788.
