BOARD OF TRUSTEES
MINUTES – MONDAY, JANUARY 22, 2007

PRESENT: Barnett, Buckley, Payne, Roncelli, Savoie, Stefanes

Also present, Attorney Van Vanerian

ABSENT: Devine

Supervisor Payne welcomed the public and led the Pledge of Allegiance.

Hearing of Special Assessment: Lakecrest Dr. Sanitary Sewer

This is the first public hearing for the Lakecrest Dr. sanitary sewer project. Special Assessment District (S.A.D.) #399 has been assigned to this project.

The estimated cost of this project is $433,500.00. Most homeowners will pay approximately $2,414.00 per year over a fifteen-year assessment period. However, final costs will be determined after actual bids are received. Final cost assessments will be presented at a second public hearing with the first assessment due in June 2007.

Bids will be presented to the Board during the second public hearing on May 14, 2007, and construction is scheduled to start in June 2007.

There were five people who spoke during public comment for the Lakecrest Dr. Sanitary Sewer Hearing of Special Assessment:

Raymond George – 3858 Crestlake

Mark Baumkel – 3826 Lakecrest Dr.

Richard Weber – 3737 Lakecrest Dr.

Charles Metzger Jr. – 3780 Squirrel Rd.

Steven Hendrick – 3818 Lakecrest Dr.

The Lakecrest Dr. Sanitary Sewer Public Hearing was closed at 8:42 p.m.

MOTION by Savoie and SUPPORT by Barnett to APPROVE the Lakecrest Dr. Sanitary Sewer Installation Project as Submitted; to Proceed with the Creation of the Special Assessment District; to Authorize the Procurement of Construction Bids and Present Them to the Board at their Meeting on May 14, 2007 with the Final Assessment Roll; and to Award the Contract.

AYES: Barnett, Buckley, Payne, Roncelli, Savoie, Stefanes

NAYS: None

ITEM #1 Approved Board Minutes of January 8, 2007 as printed.

ITEM #2 Contribution Request – Avondale Youth Assistance – John Dalton, Chairperson, and Kay Sendegas, Vice Chairperson, will be Available for Questions

John Dalton, Chairperson for Avondale Youth Assistance, made the presentation. Mr. Dalton emphasized that a major focus of this organization is the tutoring of children in the elementary schools. He stated that they are seeing marked improvements due to this program.

MOTION by Barnett and SUPPORT by Buckley to APPROVE the Requested Contribution of $2750.00 to Avondale Youth Assistance for the 2007 Fiscal Year.

ITEM #3 Consider Approval of Raffle License for TEAR "The Emergency Animal Rescue Relief" Foundation – Christopher Mian will be Available for Questions

Christopher Mian presented information about the TEAR Foundation. It is a nonprofit organization that focuses on providing charitable funding for low-income families. The State of Michigan licensing procedure requires approval of the local municipality.

MOTION by Savoie and SUPPORT by Buckley to APPROVE a Raffle License for TEAR "The Emergency Animal Rescue Relief" Foundation.

RESOLUTION

WHEREAS, that the State of Michigan requires a gaming license for any nonprofit organization conducting a raffle; and

WHEREAS, the nonprofit organization must be recognized by their local municipality in order to obtain a charitable gaming license by the State of Michigan.

THEREFORE BE IT RESOLVED that the Charter Township of Bloomfield recognizes TEAR "The Emergency Animal Rescue Relief" Foundation as a nonprofit organization operating in the community.

ITEM #4 Authorize Township Clerk to Administer 2007 – 2008 School Elections

The Board previously approved this authorization in 2005 and it was a two-year agreement for 2005 and 2006. This resolution will encompass election years 2007 and 2008.

The Board asked what would occur if this resolution was not approved. Clerk Roncelli responded that the County (Oakland) would oversee the elections instead of the Township.

MOTION by Barnett and SUPPORT by Buckley to APPROVE the Administration of the School Elections for the Next Two Years.

2007 – 2008 SCHOOL ELECTIONS RESOLUTION

BE IT RESOLVED that the Bloomfield Township Clerk consulted with the Bloomfield Township Board of Trustees to opt to administer the elections for the local school districts (Avondale, Birmingham, Bloomfield Hills and Pontiac), Oakland Community College and Oakland Intermediate School District for those residents who live in Bloomfield Township. This agreement is binding for two years. (MCL 168.305(3) as amended under PA 2887 of 2004).

ITEM #5 Consider Proposal of Jenkins, Magnus, Volk and Carroll to Perform 2006 – 2007 Township Audit

Jenkins, Magnus, Volk and Carroll has performed the Township’s audit for the last ten years. The cost of the audit will be $48,100.00, which represents a three percent increase over the previous year.

MOTION by Buckley and SUPPORT by Stefanes to APPROVE the Proposal from Jenkins, Magnus, Volk and Carroll to Perform the 2006 – 2007 Township Audit.

MOTION by Barnett and SUPPORT by Stefanes to APPROVE the Replacement Appointment to the Zoning Board of Appeals.

ITEM #7 Approve Program Manager Services for Capital Building Projects – Presented by Wayne Domine

The Program Manager will serve as a liaison between the Township and the Architect and Construction Manager.

Six proposals were submitted for this position and distributed to the Review Team for evaluation. Each proposal was reviewed based on the following criteria:

Understanding of the Project

Related Project Experience

Personnel to be Assigned the Work

Compensation for Services

The proposals were narrowed down to three individuals: Tom Marchesano, Charles Bisel, and Gregory Kreutzer. They were asked to make oral presentations to the Review Team as well as other department heads on January 8, 2007.

Each individual was evaluated on their presentation and their interaction with the Review Team. Tom Marchesano was judged to be the most qualified and self-motivated.

Marchesano was introduced to the Board and expressed his gratitude for the opportunity to work on this project.

MOTION by Stefanes and SUPPORT by Roncelli to APPROVE Tom Marchesano for the Position of Program Manager Subject to Negotiating a Contract.

ITEM #8 Approve Payroll and Vouchers

MOTION by Barnett and SUPPORT by Roncelli to APPROVE payroll and vouchers A002060-A002090; B014330-B014528; E002126-E002139 totaling $14,527,469.16.

AYES: Barnett, Buckley, Payne, Roncelli, Savoie, Stefanes

ITEM #9 Public Comment

Supervisor Payne introduced state representative, Chuck Moss and county commissioner, Marcia Gershenson.

Marcia Gershenson advised the Board that there are citizen appointments on various County Boards that are vacant.

Sharon Walker, 837 Foxhall Rd., spoke to the Board regarding builders in the Township and the duration of their projects. Supervisor Payne responded that the Township had researched the possibility of developing an ordinance that would place a time limit on the construction of a home, but found it is a violation of state law and building codes to do so. However, the Township does utilize the Ordinance Department to provide builders with motivation to complete the job in a timely manner.

Ms. Walker stated that there is a site on Foxhall Rd. that has had heavy equipment parked for awhile. Supervisor Payne said that he will look into getting the equipment moved.
