BOARD OF TRUSTEES
MINUTES – MONDAY, AUGUST 28, 2006
PRESENT: Barnett, Buckley, Devine, Payne, Roncelli, Savoie,
Also present, Attorney William Hampton
ABSENT: Stefanes
Supervisor Payne welcomed the public and led the Pledge of
Allegiance.
PUBLIC HEARING: Soil Fill Permit at 5486 Brookdale
(19-24-353-012)
Patti McCullough, Director of Planning and Building, made
the presentation.
The property owner is seeking approval for an earthen berm,
flanking his existing driveway, used to provide privacy and
noise mitigation. The plan has been reviewed and approved by
Hubbell, Roth and Clark, Inc. (HRC), the Township’s
engineering and consulting firm.
McCullough recommended that the Board approve the soil fill
permit with the following conditions:
The final grading and seeding to be completed by
October 31, 2006.
Immediate payment of the outstanding HRC engineering
review fees from 3 invoices totaling $710.53.
The berms to be property maintained pursuant to the
property maintenance regulations.
Trustee Barnett asked if the date could be sooner due to
the poor aesthetics of the property. McCullough and the
property owner, Mr. Trabucchi, responded that the work would
be completed as quickly as possible.
MOTION by Barnett and SUPPORT by Devine to APPROVE the Soil
Fill Permit at 5486 Brookdale subject to the above conditions.

ITEM #1 Approved Board Minutes of August 14, 2006 as
printed.
ITEM #2 Justice Cancer Foundation Raffle Approval
Sean Cook, Butzel Long Attorneys and Counselors, made the
presentation.
The Justice Cancer Foundation is a 501(C)(3) organization
and was founded by Dr. Elayne Arterbery. The foundation’s
purpose is to promote prostate cancer awareness and education
and provide free screening.
The foundation is hoping to raise funds by conducting a
raffle in which a local car dealership has donated a BMW
Roadster to be auctioned.
MOTION by Buckley and SUPPORT by Barnett to APPROVE the
Justice Cancer Foundation Raffle.

ITEM #3 Quit Claim Deed for Lot 18 of Supervisor’s Plat
No. 1 (Bloomfield Technology Park)
MOTION by Devine and SUPPORT by Roncelli to APPROVE the
Quit Claim Deed for Lot 18 of Supervisor’s Plat No. 1.
RESOLUTION
WHEREAS, Bloomfield Technology Park, LLC, a Michigan
Limited Liability Company, has received final site plan
approval for its development in the Township; and
WHEREAS, title work evidences the fact that title to Lot 18
of Supervisors Plat No. 1 is vested in Edmund A. Hock and
Julia M. Hock; and
WHEREAS, said title work also shows that Bloomfield
Township has an unspecified interest in Lot 18 of Supervisor’s
Plat No.1 as shown on a Residential Property Profile of Lot
18, at Oakland County Records.
NOW, THEREFORE, BE IT RESOLVED that the Township Supervisor
is hereby authorized to sign a conveyance thereby transferring
title consisting of the Township’s unspecified interest of the
above described real estate for One Dollar ($1.00) and other
valuable considerations to Bloomfield Park Technology Park,
LLC, a Michigan Limited Liability Company.

the 28th day of August 2006, the original of which is in my
office.

ITEM #4 Cross Connection Inspection Contract with Hydro
Designs, Inc.
Tom Trice, Public Works Director, made the presentation.
As required by the State of Michigan and Ordinance 252, the
Township’s water connections must be inspected for hazardous
materials that could leak into the public water system. Hydro
Designs, Inc. has completed this inspection for the last three
years with professionalism.
The new contract between the Township and Hydro Designs,
Inc. would continue through July 2009 and contains no
increases from the current contract. The Township’s attorney
and Risk Manager have reviewed it and both have given their
approval. This contract would also appoint Tom Trice as
administrator for the agreement’s duration.
A complete copy of the Hydro Designs, Inc. contract is
available in the Clerk’s office.

Cross Connection Inspection Contract with Hydro Designs, Inc.

ITEM #5 Introduction of Ordinance 573 (Water Rates) and
Ordinance 574 (Sewer Rates)
The Township has received a rate increase from the Detroit
Water and Sewerage Department and the Oakland County Drain
Commissioners. Therefore, the Township must increase their
rate in order to cover costs. This cost increase is basically
a "pass-through."
MOTION by Devine and SUPPORT by Barnett APPROVE the
Introduction of Ordinance 573 and Ordinance 574.

ORDINANCE NO._573
AN ORDINANCE TO AMEND ORDINANCE NO. 87 AS AMENDED,
ENTITLED "AN ORDINANCE ESTABLISHING RATES AND CHARGES
FOR WATER SERVICE PROVIDED BY THE BLOOMFIELD TOWNSHIP
WATER SYSTEM."
The Township of Bloomfield Ordains:
SECTION 1.01.
That Ordinance No. 87, as amended, be amended by amending
Section 5.01 to read as follows:
Section 5.01 Water Consumption Charge
A quarterly charge for water service shall be made to each
of the premises connected to the system in the amount of $3.30
per 1,000 gallons of water consumed. There shall be no minimum
water charge other than the meter charge, if any, applicable
to any premises metered for service. In those instances
wherein a premises is connected to the system and a meter has
not been installed, the quarterly charge for water service
shall be $122.10.
SECTION 2.01.
Ordinance No. 557 is specifically repealed. All ordinances
or parts of ordinances in conflict herewith are hereby
repealed only to the extent necessary to give this ordinance
full force and effect.
SECTION 3.01.
Should any section, clause or phrase of this ordinance be
declared by the court to be invalid, the same shall not affect
the validity of this ordinance as a whole, or any part
thereof, other than the part so declared to be invalid.
SECTION 4.01.
All proceedings pending and all rights and liabilities
existing, acquired, or incurred at the time this amendatory
ordinance takes effect are saved and may be consummated
according to the law in force when they were commenced.
SECTION 5.01.
Upon adoption, the provisions of this ordinance shall take
effect immediately upon publication in a newspaper circulated
within said Township and shall apply to all bills rendered for
water use on or after October 1, 2006.

OAKLAND COUNTY, MICHIGAN
ORDINANCE NO._574
AN ORDINANCE TO AMEND ORDINANCE NO. 158 AS AMENDED,
ENTITLED "AN ORDINANCE TO ESTABLISH AND REGULATE CHARGES OR
RATES FOR SEWAGE TREATMENT TO PREMISES CONNECTED INDIRECTLY TO
THE SANITARY SEWER SYSTEM OF THE TOWNSHIP OF BLOOMFIELD,
INCLUDING EVERGREEN AND FARMINGTON SANITARY SEWER SYSTEM."
The Township of Bloomfield Ordains:
SECTION 1.01.
That Ordinance No. 158, as amended, be amended by amending
Section 2.01(a) and 2.01(b) thereof to read as follows:
Section 2.01(a). Each premises not connected to the
Township water system shall pay a quarterly charge of $111.00
for sewage disposal, unless the premises private water supply
system is metered in conformance to the requirements of those
premises connected to the Township water system, then such
premises shall be charged as specified in Section 2.01 (b).
Section 2.01(b). For those premises connected to the
Township water system the quarterly sewage disposal charge
shall be $3.00 per 1000 gallons of water used by said premises
for that quarter.
SECTION 2.01 Repealer.
Ordinance No. 561 is specifically repealed. All ordinances
or parts of ordinances in conflict herewith are hereby
repealed only to the extent necessary to give this ordinance
full force and effect.

Should any section, clause or phrase of this ordinance be

ITEM #6 Transfer of Ownership in Lochslea Subdivision
MOTION by Barnett and SUPPORT by Buckley to REMOVE Transfer
of Ownership in Lochslea Subdivision from Tabled Items.
This agenda item was introduced to the Board at their June
26, 2006 meeting and was tabled until Attorney Hampton could
review.
There is concern over a wetland that is on this property.
The Township’s Engineering and Environmental department has
determined that this piece of land has significant drainage
problems.
Attorney Hampton’s recommendation is that there are only
liability issues to the Township should they accept this piece
of land.
MOTION by Barnett and SUPPORT by Savoie to DENY the
Transfer of Ownership of Outlot B in Lochslea Subdivision.

ITEM #7 Call for Truth in Taxation Hearing
Supervisor Payne advised that this hearing is scheduled and
held on an annual basis.
MOTION by Devine and SUPPORT by Roncelli to HOLD a Truth in
Taxation Hearing at the Next Township Board Meeting Scheduled
for September 11, 2006.

ITEM #8 Termination of 425 Agreement with Birmingham,
Effective 8/30/06 (For Information Only)
The Board was advised that the 425 agreement with
Birmingham will terminate on August 30, 2006 and that the
Clerk’s and Treasury departments, of both municipalities, have
been working to transfer information.
ITEM #9 Approve Payroll and Vouchers
MOTION by Roncelli and SUPPORT by Buckley to APPROVE
payroll and vouchers A001772-A001794; B012321-B012494;
E001950-E001965 totaling $5,687,264.81.
ITEM #11 Public Comment
Supervisor Payne thanked Greg Jamian, Oakland County
Commissioner, for attending the Board meeting.
There were ten people who spoke during public comment in
regards to the Bloomfield Township Building Program.
