MINUTES – MONDAY, JANUARY 9, 2006

Supervisor Payne welcomed the public and led the Pledge of Allegiance

ITEM #1 Approved Board minutes of December 12, 2005 as printed.

ITEM #2 Appointments to Board of Canvassers – John R. Bowker and Joy L. Garber (Renew until 12/31/2009)

Township Clerk Roncelli explained that the Board of Canvassers, which serves during the primary and general elections, must include Democrats and Republicans. She introduced John Bowker (Joy Garber was unable to attend). Both candidates were recommended for reappointment.

MOTION by Barnett and SUPPORT by Buckley to RENEW appointments to the Board of Canvassers.

Supervisor Payne advised the Board that the Electrical Examining and Appeals Board does not meet very often, but it is important to convene should there be an issue.

Supervisor Payne stated that this Board rarely meets, but must be staffed should the need arise.

ITEM #5 Appointment to Zoning Board of Appeals – Robert Taylor (term expiration 01/01/2006; renew for another three-year term to expire 01/01/2009)

Supervisor Payne advised the Board that Robert Taylor completed Leo Savoie’s term on the Zoning Board of Appeals. The reappointment is for a three-year term.

ITEM #6 Conceptual Proposal for Bloomfield Township Municipal Complex – Prepared by Yamasaki Associates, Inc.

Supervisor Payne made the presentation. He stated that last fall the Board approved two surveys to determine if Township voters would approve a new public services building, a suitable facility for the Senior Center, and fire station improvements. Once the conceptual proposal to build this new facility has been completed by Yamasaki, the Board will need to make a decision before the end of May if the issues are to be on the August ballot. Payne suggested that the Board might want to have a study session.

Trustee Buckley questioned the deadline for a ballot issue. Payne responded that it would be put on the August ballot if approved by the Board. The results of the survey suggested a 52% approval rate if the public services building, renovations to the Westview Rd. fire station and the Senior Center were "lumped’ together on the ballot

Treasurer Devine believes it is less expensive to do all three projects at one time. He advised the Board that we are under a "time crunch" to get this on the ballot for August – or wait until 2008 (when costs will be higher and the Township’s borrowing power may not be as great). Devine emphasized that throughout the survey there was strong support for the repairs to the fire station.

Trustee Savoie said that the Township is talking about a relatively small amount of money to do a thorough study. He agreed with Treasurer Devine that costs will only continue to go up and that the worst thing the Board could do would be to do nothing.

Trustee Buckley asked about the cost of the survey. Clerk Roncelli provided copies of the first survey to the Board, noting a cost of $5,850.00. The second survey, estimated at $8750.00, will be conducted after the Board approves a conceptual plan. The second survey will have 45 questions as compared to 28 on the first.

Trustee Stefanes expressed her concern for more Board involvement in the survey analysis. A tentative study session to review the survey is scheduled for January 19, 2006.

ITEM #7 Introduce Ordinance 568, Snow Emergency

Supervisor Payne advised the Board that most municipalities have had such an ordinance in place for a long time.

This ordinance will give the opportunity for the police department to call a snow emergency and then residents will need to remove their cars from the streets. If they do not, then there would be a fine and the car would be impounded. Payne stated that he would like to get this ordinance in place as soon as possible and use all media formats to inform residents about the new regulations.

Trustee Savoie questioned the special circumstances permit fee. Supervisor Payne replied that the Township wanted to deter too many residents from seeking a permit. Clerk Roncelli noted that the ordinance states a fee will be charged, but the amount of the fee, if approved, must be determined by a resolution.

ORDINANCE NO. 568

CHARTER TOWNSHIP OF BLOOMFIELD

OAKLAND COUNTY, MICHIGAN

AN ORDINANCE TO PROHIBIT PARKING ON PUBLICLY MAINTAINED STREETS WITHIN BLOOMFIELD TOWNSHIP DURING A SNOW EMERGENCY.

IT IS THE PURPOSE OF THIS ORDINANCE TO PROTECT THE PUBLIC HEALTH, SAFETY AND WELFARE BY PROHIBITING PARKING ON PUBLICLY MAINTAINED STREETS IN THE TOWNSHIP DURING A SNOW EMERGENCY TO ENSURE THAT THE TOWNSHIP HAS THE ABILITY TO PLOW, SALT OR UNDERTAKE OTHER SNOW OR ICE REMOVAL ACTIVITY TO PREVENT TRAFFIC AND PEDESTRIAN HAZARDS.

THE CHARTER TOWNSHIP OF BLOOMFIELD ORDAINS:

Section 1. Definitions.

"Police Chief" shall mean the Bloomfield Township Police Chief or his or her designated representative.

"Snow Emergency" shall mean a declaration of a snow emergency publicly announced at the direction of the Police Chief, which is announced by means of broadcast and/or telecast from stations with normal operating range covering the Township, including, but not limited to, cable television. The declaration may further be made in a newspaper of general circulation when feasible.

"Street or Road" shall include the entire width between the boundary lines of every way which is publicly maintained, and which is open to the use of the public for purposes of vehicular travel.

Section 2. Prohibition Against Parking on Publicly Maintained Streets During Declaration of a Snow Emergency.

No person shall park or leave any vehicle on a street in Bloomfield Township when a Snow Emergency has been declared. The Snow Emergency shall remain in effect until terminated by announcement in accordance with this Ordinance, except that any street that has been completely plowed and is substantially clear of snow and ice, from curb to curb, for the length of the entire street shall be excluded from the Snow Emergency.

Section 3. Stalled or Disabled Vehicles.

Whenever a vehicle becomes stalled or disabled for any reason, on any portion of a street to which the Snow Emergency parking prohibition applies, the person operating the vehicle shall take immediate action to have the vehicle towed or pushed off the street. No person shall abandon or leave his or her vehicle in any street (regardless of whether the person indicates by raising the hood or otherwise, that the vehicle is stalled), except for the purpose of securing assistance during the actual time necessary to go to a nearby phone, or nearby garage, automobile service station, or other place of assistance and return without delay.

Section 4. Violations and Penalties.

Any person in violation of this Ordinance is responsible for a civil infraction, punishable by a fine not to exceed $100.00.

Section 5. Presumptions.

In any proceeding for violation of this Ordinance relating to parking, leaving, or abandoning a vehicle, proof that the particular vehicle described in the complaint or citation was parked or left in violation of this Ordinance, together with proof that the respondent named in the complaint or citation was, at the time of such parking, the registered owner of such vehicle, shall constitute a presumption that the registered owner of such vehicle was the person who parked or left such vehicle at the locations in which the violation occurred.

Section 6. Impoundment of Vehicle.

Any vehicle parked or left on any street in violation of this Ordinance constitutes a public hazard and an obstruction of traffic, and may be towed and impounded immediately. No person may recover an impounded vehicle without first paying the cost of removal and storage, notwithstanding, and apart from, any fine which may be imposed for violation of this Ordinance.

Section 7. Exemptions; Special Parking Permit.

An owner of a vehicle who occupies a premises that does not have a driveway shall be exempt from the requirement to move said motor vehicle in the event of a snow emergency. The owner of the motor vehicle upon application to the Police Department will receive a special parking permit, which shall be displayed in the front-side window on the driver’s side of the vehicle. A fee for the special parking permit will be established by the Board of Trustees.

Section 8. Short Title.

This Ordinance shall be known and may be cited as the "Snow Emergency Ordinance."

Section 9. Repealer.

All other Ordinances or parts of Ordinances in conflict herewith are hereby repealed only to the extent necessary to give this Ordinance full force and effect.

Section 10. Severability.

Should any section, subdivision, clause or phrase of this Ordinance be declared by the courts to be invalid, the same shall not affect the validity of the Ordinance as a whole or any part thereof, other than the part so invalidated.

Section 11. Savings.

All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this Ordinance takes effect are saved and may be consummated according to the law in force when they are commenced.

Section 12. Effective Date.

This ordinance shall take immediate effect upon publication.

ITEM #8 Greater Bloomfield Senior Association Lease for Adult Day Care

The presentation was made by Christine Tvaroha, Director, Greater Bloomfield Senior Association. Tvaroha said adult day care provides a safe environment for the attendees and gives a break to the caregiver, who is often a senior themselves.

The hours of operation will be Monday through Friday, 8:30 a.m. to 5:00 p.m., with a maximum number of 24 clients.

There are three nonprofit organizations in other communities interested in bidding on assisting with this day care.

The proposed budget is a five-year projection. The revenue projections are conservative. She budgeted $40.00 per day per client, as opposed to the national average of $56.00 per day. While the break-even point is set for year five, she believes it could be reached in year three. Securing their own building in the future would provide great savings as rent is the second highest line item in the budget.

Tvaroha requested approval of the lease for 2222 Franklin Rd. as an adult day-care facility. Site advantages include good security, parking close to the door, a one-floor facility, and a location easily accessible from all parts of the Township. As an added incentive, the landlord has offered three months free rent and money towards the renovation.

The facility will open in May and five families are already on a waiting list.

A complete copy of this lease is on file in the Bloomfield Township Clerk’s Office.

ITEM #11 Public Comment

Clerk Roncelli advised the Board of the passport revenue success for the year 2005 and stated that her goal for 2006 is $50,000.00 or $1000.00 per week. Trustee Stefanes said that she thought that accepting passports in the Township was great. Roncelli said that the Township has had a wonderful response from residents and nonresidents (25% of passport applicants were from other areas).

John Bowker, Board of Canvasser member, told the Board that they are to be commended. He is glad to see such harmony among them, even with dissenting opinions.
