Seeking approval for a 33’ 3" encroachment into the required 40 ft. front yard setback and a 7’ encroachment into the required 16’ side yard setback for the construction of a proposed new home, located 6’ 9" from the front lot line and 9’ from the side lot line. Also seeking for a 7’ encroachment into the required 16’ side yard setback for the installation of two air-conditioning units, screened from view with existing trees and proposed plantings, located immediately adjacent to the residential building 9’ from the westerly side lot line on vacant Lots 33 and 34, Square Lake Country Club, Section 6. The Code of the Charter Township of Bloomfield, Chapter 42, Article III, Section 42-527 requires a minimum of 40’ in the front yard setback, and a minimum of 16’ in the side yard setback. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that ground-mounted mechanical and electrical equipment shall not be located in the required 16’ side yard setback, shall be screened from view, and that evergreen plant material utilized in vegetative screen walls shall be maintained in a healthy condition. Seeking approval to encroach 4’ 9" into the required 16’ side yard setback for the installation of accessory structures, proposed pool equipment with an overall height of 3’ 6", screening with proposed evergreen plantings, located in a side yard 11’ 3" from the southerly side lot line on Lot 144, Judson Bradway’s Bloomfield Village, Section 26. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that ground mounted mechanical or electrical equipment shall not be located in the required 16’ side yard setback, shall be screened from view through the use of evergreen plant material at least the height of the equipment screen wall and located at the point of placement of the equipment, and that evergreen plant material utilized in vegetative screen walls shall be maintained in a healthy condition. Seeking approval for a 5’ encroachment into the required 40’ front yard setback for the construction of a proposed single-story porch addition located 35’ from the front lot line on Lot 123, Westchester Village No.1, Section 34. The Code of the Charter Township of Bloomfield, Chapter 42, Article III, Section 42-527 requires a minimum of 40’ in the front yard setback. Seeking approval for an existing accessory structure, a 5’ x 3’ 6" x 5’ high stand-by generator, located in a side yard, below grade in a shaft that exists between buildings, Unit 11, Wabeek on the Lake Condominium, Section 18. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states within the One-Family Cluster districts, ground mounted mechanical or electrical equipment shall be permitted in any rear yard when placed immediately adjacent to the residential building, that said equipment shall be obscured from view by a screen wall consisting of materials identical to those used on the main building they are to serve, or through the use of evergreen plant material at least the height of the equipment screen wall and located at the point of placement, and that evergreen plant material utilized in vegetative screen walls shall be maintained in a healthy condition. Seeking approval for the installation of proposed wood fencing with an overall height of 4’, located in front yards, Franklin Road and West Long Lake Road frontages. Also seeking approval for the installation of three manual gates with an overall height of 6’, located across the three driveway entrances, Franklin Road frontage, Lot 11, Franklin-Long Lake Road Estates, Section 17. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-566 states that fences in a residential district must be located in a side or rear yard and shall not exceed 4’ in height. Seeking approval for the construction of proposed stone retaining walls with a separation of less than 8’, and an overall height of 7’ for the purpose of creating a raised patio, screened with existing trees and proposed plantings, located in a rear yard 22’ from the southerly side lot line and more than 100’ from the rear lot line on Lot 12, Bloomfield Hills Estates, Section 12. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-566 states that retaining walls located more than eight (8) feet from a property line shall not exceed four (4) feet in height above the lowest adjacent grade level, that tiered walls having a horizontal separation of less than eight (8) feet shall be reviewed as one (1) wall that shall not exceed four (4) feet in combined height, and shall be screened with landscape plantings to consist of at least 75% evergreen plantings. Seeking approval for the following variances to allow renovations on Lot 1187, Judson Bradway’s Bloomfield Village No. 5, Section 34:

The installation of a proposed 6’ high vinyl fence with a gate extending from the wall of the building towards the easterly side lot line, located in side and rear yards along the easterly side lot line.

A 10’ 1" encroachment into the required 35’ rear yard setback for a partially constructed single-story garage addition to the existing non-conforming home, located 24’ 11" from the rear lot line.

The installation of a proposed 2’ 6" high fence and gate to be used as a dog run area, located in a rear yard 20’ 10" from the westerly side lot line, 11’ 8" from the rear lot line, and 38’ 9" from the easterly side lot line.

An existing air-conditioning unit, located in a rear yard, screened on two sides with an existing 4’ high vinyl fence, located 8’ from the wall of the building and 24’ 7" from the westerly side lot line.

The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-566 states that fences in a residential district shall not exceed 4’ in height. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-558 states that non-conformities shall not be enlarged upon, expanded, or extended. The Code of the Charter Township of Bloomfield, Chapter 42, Article III, Section 42-527 requires a minimum of 35 ft. in the rear yard setback. The Code of the Charter Township of Bloomfield, Chapter 8, Article II, Section 8-26 states that all outdoor enclosures and fenced dog run areas, are subject to the review and approval by the Zoning Board of Appeals and that dogs shall not be confined or restrained in any manner except within the rear yard in an area set back at least 25’ from the rear lot line and 16’ from the side lot line. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that ground-mounted mechanical and electrical equipment shall be located immediately adjacent to the residential building. Seeking approval for an existing accessory structure, an existing air-conditioning unit, screened with a proposed 4’ high redwood fence, located in a secondary front yard immediately adjacent to the southwesterly wall of the building, Rambling Way frontage. Also seeking approval for the installation of a proposed 6’ high vinyl privacy fence, located in the northeasterly side yard on Lot 200, Bloomfield Hickory Grove Subdivision, Section 9. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that ground mounted mechanical and electrical equipment may be permitted in side or rear yards. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 566 states that fences in a residential district must be located in a side or rear yard and shall not exceed four (4) ft. in height. Seeking approval for an existing accessory structure, a portable storage unit to remain on site until August 31st, 2008, screened with existing trees, located in a side yard 16’ from the northerly side lot line and 60’ from the rear lot line on Lot 45, Balmoral Orchards No. 2, Section 30. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that accessory structures shall not be erected in any yard, except a rear yard, shall be screened from adjacent residences with evergreen and deciduous material, which will obscure view twelve (12) months of the year, that such vegetation shall be maintained in a healthy condition, and shall require the review and approval of the Zoning Board of Appeals. Seeking approval for the construction of an accessory structure, a proposed 6’ x 1’ 10" high permanent boardwalk, constructed of wood, located in a rear yard extending 15’ from the water’s edge; within the natural feature area. Also seeking approval for the installation of a lawn, located in a rear yard, ranging from 0’ to 20’ within the natural feature area, Unit H3, Heron Park, Section 7. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that accessory structures shall be screened from adjacent residences with evergreen and deciduous material, which will obscure view twelve (12) months of the year, that such vegetation shall be maintained in a healthy condition, and shall require the review and approval of the Zoning Board of Appeals. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-573 requires a twenty-five (25) ft. setback from the boundary or edge of a wetland. Seeking approval for the installation of an existing accessory structure, an 8’ x 6’ x 7’ 1" high resin storage shed, screened with existing and proposed trees and plantings, located in a front yard 2’ from the easterly rear lot line and 64’ from the secondary front lot line, Peabody Drive frontage, Lot 72, Peabody Orchards No.1, Section 28. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that accessory structures shall not be erected in any yard, except a rear yard, shall not be located closer than sixteen (16) ft. to any side or rear lot line, shall be screened from adjacent residences with evergreen and deciduous material, which will obscure view twelve (12) months of the year, that such vegetation shall be maintained in a healthy condition, and shall require the review and approval of the Zoning Board of Appeals. Seeking approval for an existing accessory structure, an 8’ x 11’ x 7’ high storage shed, screened with existing plantings, to be located in a rear yard 18’ from the northerly side lot line and 25’ from the rear lot line on Lot 66, Still Meadow, Section 16. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that accessory structures shall be screened from adjacent residences with evergreen and deciduous material, which will obscure view twelve (12) months of the year, that such vegetation shall be maintained in a healthy condition, and shall require the review and approval of the Zoning Board of Appeals. (14) Seeking approval for the installation of an accessory structure, a proposed 7’ 10" x 7’ 10" x 3’ high hot tub, screened with existing trees, located in a rear yard 40’ from the rear lot line and 133’ from the southerly side lot line. Also seeking approval for an existing fire pit with two 2’ high masonry benches, screened with existing trees, located in a rear yard 18’ from the rear lot line and approximately 90’ from the southerly side lot line on Lot 21, Lone Pine Heights No.1, Section 19. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that accessory structures shall be screened from adjacent residences with evergreen and deciduous material, which will obscure view twelve (12) months of the year, that such vegetation shall be maintained in a healthy condition, and shall require the review and approval of the Zoning Board of Appeals. Seeking approval for the construction of a proposed 25’ x 45’ sports court without fencing or lighting, screened with existing and proposed trees, located in a rear yard 27’ 6" from the rear lot line and 16’ from the easterly side lot line on Lot 7, Kent Ridge Subdivision, Section 27. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-559 states that accessory structures shall be screened from adjacent residences with evergreen and deciduous material, which will obscure view twelve (12) months of the year, that such vegetation shall be maintained in a healthy condition, and shall require the review and approval of the Zoning Board of Appeals. Seeking approval for the installation of a proposed 8’ 6" x 4’ 9" (40 sq. ft.) wooden, non-illuminated, ground sign for Franklin Christian Pre-School in addition to the existing monument sign for St. George Greek Orthodox Church having a setback of 352’, located in a front yard 12’ from the front lot line Woodward Avenue frontage on Part of Lot 11, also all of Lots 12 and 13, Bloomfield Highlands Subdivision, Section 4. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-568 states that one (1) ground sign shall be allowed in the R-2, Single Family, zoned district, that permanent ground signs shall be constructed of noncombustible material, and shall be set back from the lot line at lease one-third (1/3) of the distance from the lot line to the nearest building, but need not be set back more than one hundred (100) feet from the property line. Seeking approval for the installation of three signs on Acreage Parcel C270F-1-2, Section 28:

 The installation of a two-sided illuminated ground sign for Tim Horton’s, located in front yards on the westerly front lot line and 5’ 4" from the southwesterly front lot line, Maple and Telegraph Road frontages, in conjunction with the existing ground sign for the BP service station. The altered ground sign would measure 6’ 5" x 5’ high (32 sq. ft. per sign face)

 The installation of a proposed 16’ 10" x 3’ 6" high (58.9 sq. ft.) illuminated wall sign for Tim Horton’s, located on the westerly elevation (5.7% of the total street side faηade), Telegraph Road frontage.

 The installation of a proposed 9’ 7" x 2’ high (19 sq. ft.) illuminated wall sign for Tim Horton’s, located on the southerly elevation (3.1% of the total street side faηade), Maple Road frontage.

The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-558 states that non-conformities shall not be enlarged upon, expanded, or extended. The Code of the Charter Township of Bloomfield, Chapter 42, Article IV, Section 42-568 states that not more than one (1) wall or ground sign may be erected within B-3, General Business, zoned district, that no ground sign shall be located nearer than twenty-five (25) feet to any existing or proposed right-of-way line. THE ZONING BOARD OF APPEALS APPROVALS SHALL BE VALID FOR A PERIOD NO LONGER THAN ONE YEAR UNLESS A BUILDING PERMIT HAS BEEN OBTAINED.

IN THE EVENT THAT AN APPEAL IS APPROVED, CONTINGENT UPON THE SUBMITTAL OF AN AFFIDAVIT, PLEASE ALLOW UP TO FOURTEEN (14) BUSINESS DAYS TO PROCESS THE DOCUMENT.

APPROVED MINUTES WILL BE AVAILABLE ON LINE AND AT THE PLANNING DIVISION AFTER THE NEXT SCHEDULED BOARD OF APPEALS MEETING.
